ORDINANCE NO. 376
AN ORDINANCE OF THE BOARD OF ALDERMEN OF THE TOWN OF
WESTLAKE, TEXAS, AMENDING ORDINANCE NO. 332, SECTION S, N:
AMENDMENTS TO THE UNIFORM FIRE CODE, RELATIVE TO
RESIDENTIAL FIRE SPRINKLER PROVISIONS; PROVIDING FOR A
PENALTY CLAUSE; PROVIDING FOR A SEVERABILITY CLAUSE; AND
PROVIDING FOR AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE TOWN OF WESTLAKE, TEXAS:
SECTION 1: That Section S, Subsection N of Ordinance No. 332 be amended to
read as follows:
N) Section 1003.2.1 of the Code shall be amended to be and read as follows: An
approved automatic fire sprinkler system shall be installed as follows:
1. In all new buildings of any area, size or occupancy constructed after July 1,
1999, in the absence of specific provisions within this Code.
2. In all additions to existing buildings, other than additions under 6,000 square
feet in area to Group R, Division 3 occupancies initially constructed prior to
July 1, 1999. An approved automatic fire sprinkler system shall be installed in
the addition as well as the existing building unless separated by an approved
area separation wall.
3. In new construction of Group R, Division 3 occupancies over 6,000 square
feet in area, excluding exterior porches and balconies that are not enclosed and
are accessible from the building perimeter. Unless otherwise specified, the
floor area shall be that as defined in Article 2, Section 207 of the Code, and
shall include garages, bonus rooms and unfinished or semi -finished useable
space within the exterior walls of the building.
4. In detached Group U, Division 1 occupancies, accessory to private residential
or agricultural uses, where the floor area exceeds 3,000 square feet.
5. Unless otherwise required by this Code, the following exceptions apply:
a. Any single-family residence under 6,000 square feet in area.
b. Any detached Group U, Division 1 occupancy under 3,000 square feet in
area, and accessory to a private residential or agricultural use.
In any existing building of any size, area, or occupancy, other than Group
R, Division 3 occupancies initially constructed prior to July 1, 1999, that
are reconstructed after the effective date of this ordinance where 50% or
greater of either the square footage or the dollar value is involved.
d. This amendment supersedes any exceptions of occupancies and class
retained in section 1003.2.
SECTION 2: Violation and Penalties. Any person who violates any provision of
this ordinance shall be deemed guilty of a misdemeanor and shall be punished by a fine of
not less than five hundred {$500.00) dollars nor more than two thousand ($2000.00)
dollars. If a violation continues, each day's violation shall be deemed a separate offense.
SECTION 3: Severability. The provisions of this ordinance are declared to be
severable. If any section, sentence, clause, or phrase of this ordinance shall for any
reason be held to be invalid or unconstitutional by a court of competent jurisdiction, the
decision shall not affect the validity of the remaining sections, sentences, clauses, and
phrases of this ordinance, but they shall remain in effect; it being the legislative intent
that this ordinance shall remain in effect notwithstanding the invalidity of any part.
