HomeMy WebLinkAboutOrd 366 Extending moratorium Declaring a 90 day moratorium on the installation or construction of any commerical wireless antennasTOWN OF WESTLAKE ORDINANCE NO. 366 AllORDINANCE OF THE BOARD OF ALDERMEN OF THE TOWN OF WESTLAKE, TED.AS, AMENDING ORDINANCE NO. 353 WHICH DECLARED A NINETY (90) DAY IM-OFtATORIUM ON THE PERMITTING, INSTALLATION, OR CONSTRUCTION OF ATIP(COMMERCIAL WIRELESS ANTENNA FACILITY WITHIN THE CORPORATE ILTMI7' S OF THE TOWN BY EXTENDING THE TERM OF THE MORATORIUM lUl'47FIL 11:59 P.M. ON AUGUST 21, 2000; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING THAT THIS ORDINANCE SHALL TAKE EFFECT IN[ME1DIATELY UPON PASSAGE. "I HEREAS, the Town of Westlake enacted Ordinance 353 on March 27, 2000, whereby it declared a ninety (90) day moratorium on the permitting, installation, or construction of any commercial wireless antenna facility within the corporate limits of the Town; and "NHEREAS, the Town is currently preparing rules and regulations governing the perniitting, installation or construction of any commercial wireless antenna facility within the coiTorail e limits of the Town; _"iOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE TOWN OF WESTLAKE, TEXAS: SECTION 1: That all of the above premises are found to be true and correct and are inc:;orporated into the body of this Ordinance as if copied in their entirety. "ECTION 2: That the moratorium established by Ordinance No. 353 is hereby extended until 11:59 p.m. on August 21, 2000. 'SECTION 3: It is hereby declared to be the intention of the Board of Aldermen that the pfimscs, clauses, sentences, paragraphs and sections of this Ordinance are severable and if any phrase, clause, sentence, paragraph or section of this Ordinance shall be declared legally invalid or ulco:nstitutional by the valid judgment or decree of any court of competent jurisdiction, such legal invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sei ,aces, paragraphs and sections of this Ordinance, since same would have been enacted by the Bca-d of Aldermen without the incorporation in this Ordinance of any such legally invalid or unconstitutional phrase, clause, sentence, paragraph or section. SECTION 4: This Ordinance shall take effect immediately upon passage.
