ON AUGUST 28, 2000, THE MORATORIUM IESTASLISHED BY ORDINANCE NO. 354 ENACTED BY THE TOWN OF M'.E'STLAKE, TEXAS, ON MARCH 27, 2000, ON THE ISSUANCE, ACCEPTANCE OR AID1111,01VAL OF ANY PERMITS, APPLICATIONS, SITE PLANS, ZONING A-MENOMENTS, PRELIMINARY PLATS AND FINAL PLATS ON ALL PROPERTY IN Yiu. TOWN 0 WESTLAKE ZONED R-20, R -20C, R-40 AND R -40C; PROVIDING A Sl['V E.RABILITY CLAUSE; AND PROVIDING THAT THIS ORDINANCE SHALL T.Ad"0E (EFFECT IMMEDIATELY UPON PASSAGE. WHEREAS, on March 27, 2000, the Board of Alderman of the Town of Westlake, Texas, enacted Ordinance 354 which declared a moratorium on the issuance, acceptalice or approval of any permits, applications, site plans, zoning amendments, preliminary pleats and final plats on all property in the Town of Westlake zoned R-20, R -20C, R-40 and R- 40C- until 11:59 p.m. on June 25, 2000; and leVIIEREAS, in Ordinance No. 354 the Town Manager and his designees were directed to conduct investigations in conjunction with the compatibility of minimum lot sizes and district regulations within the aforementioned zoning districts; and WHEREAS, the investigations referenced herein have not yet been completed; and "WHEREAS, in order to allow sufficient time to adequately conduct the investigations contemplated herein, the Town desires to extend the term of the moratorium established by Ordinance No. 354 until 11:59 p.m. on August 28, 2000. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE T1[-)1VN OF WESTLAKE, TEXAS: ;iECTION 1: That all of the above premises are found to be true and correct and are hereby incorporated into this Ordinance as if copied in their entirety. SECTION 2: That all of the terms and conditions contained in Ordinance No. 354 of the Town of Westlake, Texas, are hereby extended in their entirety until 11:59 p.m. on August 28, 2030. ;SECTION 3: It is hereby declared to be the intention of the Board of Aldermen of the To,"n cif Westlake, Texas, that phrases, clauses, sentences, paragraphs or sections of this Ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this Ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court oil competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs or sections of this Ordinance, since same would have been. enacted by the Board of Aldermen of the Town of Westlake without the incorporation in this O-rdinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. SECTION 4: This Ordinance shall take effect immediately upon. passage. PASSED AND APPROVED THIS 26T" DAX OF JUNE, 2000.
