AN ORDINANCE BY THE BOARD OF ALDERMEN OF THE TOWN OF
WESTLAKE, TEXAS DECLARING A VACANCY ON THE BOARD OF ALDERMEN
AND CALLING AND ORDERING AN ELECTION TO BE HELD ON MAY 6, 2000,
THE FIRST SATURDAY IN THAT MONTH, FOR THE PURPOSE OF ELECTING AN
ALDERMAN FOR THE TOWN OF WESTLAKE, TEXAS, IN ACCORDANCE WITH
THE PROVISIONS OF SECTION 22.010, LOCAL GOVERNMENT CODE;
ESTABLISHING THE HOURS AND PLACE FOR THE ELECTION; PROVIDING FOR
THE POSTING OF NOTICE OF THE ELECTION; ESTABLISHING THE PERIOD
FOR FILING FOR A PLACE ON THE BALLOT; DIRECTING THE TOWN
SECRETARY TO MAKE UP THE OFFICIAL BALLOTS, AND CAUSE THEM TO BE
PRINTED AND DELIVERED TO THE PRESIDING OFFICER; APPOINTING A
PRESIDING JUDGE; PROVIDING FOR THE CANVASSING OF THE RETURNS OF
THE ELECTION; AND DECLARING AN EFFECTIVE DATE.
WHEREAS, Abe Bush, Jr. was elected to the office of Alderman of the Town of
Westlake for a two year term at the regular municipal election held May 1, 1999; and
WHEREAS, Mr. Bush has resigned from the Town of Westlake Board of Aldermen ,
thereby causing his office as Alderman to be considered vacant as provided in Section 22.012
of the Local Government Code.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE TOWN
OF WESTLAKE, TEXAS:
SECTION 1: That the office of Alderman held by Abe Bush, Jr. is hereby declared
vacant in accordance with Section 22.012 of the Local Government Code.
SECTION 2: That an election shall be held at the Town Hall, 3 Village Circle, Suite
207, in the Town of Westlake, Texas, between the hours of 7:00 a.m. and 7:00 p.m. on May
6, 2000, the first Saturday of that month, for the purpose of electing an Alderman to fill the
unexpired term of the vacant office of the Town of Westlake, Texas, in accordance with
Section 22.010 of the Focal Government Code.
SECTION 3: That the period for filing applications for a place on the ballot will
begin on Wednesday, March 15, 2000, and end at 5:00 p.m. on Wednesday, April 5, 2000.
SECTION 4: That early voting by personal appearance shall be held at the Town
Hall, 3 Village Circle, Suite 207, in the Town of Westlake, Texas between the hours of 9:00
a.m. and 1:00 p.m. beginning on Wednesday, April 19, 2000, and ending on Tuesday, May 2,
2000.
SECTION 5: That the candidate receiving the highest number of votes shall be elected
to the Board of Aldermen of the Town of Westlake to fill the remaining unexpired term.
SECTION 6: That notice of the election shall be given by posting true copies of this
Ordinance, signed by the Mayor and attested by the Town Secretary, in the Town Hall, for at
least twenty (20) consecutive days prior to the date of the election.
SECTION 7: That Wanda Haskins is hereby appointed presiding judge of the election
and the presiding judge shall appoint such assistants as may be necessary to properly conduct
the election, as provided by the Election Code.
SECTION 8: That the Town Secretary shall make up the official ballot from the names
presented to her by application as provided by the Election Code, and she is hereby authorized
and directed to have the ballots to be used in the election printed and delivered to the presiding
judge.
SECTION 9: That immediately after the counting of the votes the presiding judge shall
deliver the official returns of the election to the Town Secretary.
SECTION 10: That on the Tuesday next following the election, the Board of Aldermen
shall canvass the returns and declare the results which shall be recorded in the Minutes of the
Board of Aldermen.
SECTION 11: That the candidate receiving the highest number of votes for Alderman
shall be elected to the unexpired term, and the Mayor shall deliver a certificate of election to
the successful candidate. If two or more candidates for Alderman tie with the same number of
votes the Board of Aldermen shall order a second election to be held on the fourteenth day
after the first election at which only the names of the candidates who receive the same number
of votes at the first election shall be printed on the ballot. In the event of a tie at the second
election, the tied candidates shall cast lots to determine which one shall be declared elected.
