HomeMy WebLinkAboutOrd 349 Requiring on-site security for certain developmentsTOWN OF WESTLAKE TEXAS ORDINANCE NO. 349 AN ORDINANCE OF THE TOWN OF WESTLAKE REQUIRING ON-SITE SECURITY FOR CERTAIN DEVELOPMENTS, PROVIDING A SAVINGS CLAUSE, AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Town of Westlake, pursuant to the general police power, the authority granted to cities and towns by the Texas State Constitution, and State Statutes, is authorized to regulate development activity within the corporate limits of the Town; and WHEREAS, commercial developments under construction result in significant personal and physical property risk to the property owner and the community at large; and WHEREAS, the public safety resources of the Trophy Club/Westlake Department of Public Safety are potentially subject to overexposure in the event that commercial property developments are not adequately protected during construction; and WHEREAS, this ordinance is enacted to promote the public health, safety and general welfare of the citizens of the Town of Westlake. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE TOWN OF WESTLAKE: SECTION 1: That all matters stated in the preamble are found to be true and correct and are incorporated herein as if copied in their entirety. SECTION 2: All property owners who have Building Permits outstanding on commercial property with 6,000 or more square feet of heated air-conditioned space within the Town limits of the Town of Westlake are required to provide on-site security patrol services for this property. The security patrol services required under this ordinance shall consist of a minimum of hourly on-site patrols between the hours of 7:00 p.m. and 7:00 a.m. on a daily basis. Hourly patrols shall also be required during any time the construction site subject to the Building Permit is closed, vacant, or when no construction activity is occurring on the property. The security patrols required hereunder must be provided by a properly licensed security firm acceptable to the Town of Westlake. SECTION 3: Violations and Penalties. Any person who violates any provision of this ordinance shall be deemed guilty of a misdemeanor and shall be punished by a fine of not less than $200 dollars nor more than $2,000.00 dollars. If a violation continues, each day's violation shall be deemed a separate offense. SECTION 4: Conflicting Ordinances. All other ordinances of the Town of Westlake that are in conflict with this ordinance are hereby repealed to the extent of such conflict. SECTION 5: Severability. The provisions of this ordinance are declared to be severable. If any section, sentence, clause, or phrase of the ordinance shall for any reason be held to be invalid or unconstitutional by a court of competent jurisdiction, such decision shall not affect the validity of the remaining sections, sentences, clauses, and phrases of this ordinance, but they shall remain in effect; it being the legislative intent that this ordinance shall remain in effect notwithstanding the validity of any part.
