ORDINANCE NO. 348
AN ORDINANCE OF THE BOARD OF ALDERMEN OF THE TOWN OF
WESTLAKE, TEXAS, REGULATING THE MINIMUM STANDARDS FOR
THE INSTALLATION OF UNDERGROUND UTILITIES IN THE TOWN OF
WESTLAKE, PROVIDING A SAVINGS CLAUSE, AND PROVIDING AN
EFFECTIVE DAH.
WHEREAS, the Town of Westlake, pursuant to the general police power, the
authority granted to cities and towns by the Texas State Constitution, and State Statutes,
is authorized to regulate development activity within the corporate limits of the Town;
and
WHEREAS, the installation of underground utilities involves activity which is
critical to the integrity of the infrastructure of the Town; and
WHEREAS, the regulation of the minimum standards for the installation of
underground utilities will assist the Town in ensuring the protection of the Town's
infrastructure; and
WHEREAS, this ordinance is enacted to promote the public health, safety and
general welfare of the citizens of the Town of Westlake.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE TOWN OF WESTLAKE, TEXAS:
SECTION 1: That all matters stated in the preamble are found to be true and
correct and are incorporated herein as if copied in their entirety.
SECTION 2: All underground utility installations greater than eighteen (18)
inches in depth, including storm drainage, in the Town of Westlake, on private property
and easements (not including public rights-of-way), must, at a minimum, comply with all
applicable local, State, and Federal laws and regulations. These underground utility
installations must also conform to the Town of Westlake Engineering Standards along
with the latest Public Works Specifications published by the North Central Texas Council
of Governments. All these utility installations must be tested as outlined in the Town's
standards, and the results of the tests must be submitted to the Town Engineer.
The Town must be notified of the installation of any underground utilities greater
than 18 inches in depth, including the schedule for the work, at least forty eight (48)
hours prior to the commencement of installation.
As a condition of final plat execution, as -built drawings of all underground utility
installation greater than 18 inches in depth, must be furnished to the Town by the
contractor.
SECTION 3: Violation and Penalties. Any person who violates any provision of
this ordinance shall be deemed guilty of a misdemeanor and shall be punished by a fine of
not less than two hundred ($200.00) dollars nor more than two thousand ($2000.00)
dollars. If a violation continues, each day's violation shall be deemed a separate offense.
In addition, any installation of underground utilities which is not constructed in
conformance with the requirements of this ordinance shall be subject to mandatory
removal and reinstallation, at the sole cost of the property owner.
SECTION 4: Conflicting Ordinances. All other ordinances of the Town of
Westlake that are in conflict with this ordinance are hereby repealed to the extent of the
conflict.
SECTION 5: Severability. The provisions of this ordinance are declared to be
severable. If any section, sentence, clause, or phrase of this ordinance shall for any
reason be held to be invalid or unconstitutional by a court of competent jurisdiction, the
decision shall not affect the validity of the remaining sections, sentences, clauses, and
phrases of this ordinance, but they shall remain in effect; it being the legislative intent
that this ordinance shall remain in effect notwithstanding the invalidity of any part.
