RESOLUTION 00-52
A RESOLUTION OF THE BOARD OF ALDERMEN OF THE TOWN OF
WESTLAKE, TEXAS, AUTHORIZING THE TOWN MANAGER TO ENTER
INTO A CONTRACT WITH THE HOGAN CORPORATION FOR THE
ENGINEERING OF APPROXIMATELY 4,100 LINEAR FEET OF 12 -INCH
WATER MAIN AND 3,100 LINEAR FEET OF 8 -INCH WATER MAIN; AND
DECLARING AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF
ALDERMEN OF THE TOWN OF WESTLAKE, TEXAS:
SECTION 1: That the Board of Aldermen of the Town of Westlake, Texas,
hereby authorize the Town Manager to enter into a contract with The Hogan Corporation
for the engineering of approximately 4,100 linear feet of 12 -inch water main and 3,100
linear feet of 8 -inch water main, attached to this resolution as Exhibit A.
SECTION 2: That this Resolution shall become effective upon its passage and
approval.

Re: Nater Main Extensions
Dear Mayor and Board Members:
The Hogan Corporation (Engineer) has been requested by Mr. Trent Petty, Town Manager, to
prepare plans, specifications, and bidding documents -for the construction of approximately
4,100 linear feet of 12 -inch water main and 3,100 linear feet of 8 -inch water main. The
proposed water mains will extend from the new Dove Road water main to Stagecoach Hills
and to Aspen Lane. This letter details the scope of services requested and includes a proposal
to perform those services.
We herewith offer the Town of Westlake (Town) our professional engineering and technical
services for the Design, Bidding and Construction phases for development of approximately
4,100 linear feet of new 12 -inch water main and approximately 3,100 linear feet of new 8 -inch
water main, including all related appurtenances. The Engineer will prepare construction
plans, specifications, and bidding documents, and assist the Town in receiving bids, awarding
a contract, and conducting general review of construction on the above referenced project in
accordance with the plans and specifications. The projected cost of construction for this
project, including pipe, embedment, fire hydrants, valves and related appurtenances, is
approximately $283,000*. A "Projected Cost of Construction" tabulation is attached for your
reference.
* The cost projection included above was prepared for budget purposes only and is not guaranteed
as the exact amount which will be bid for furnishing and installing the proposed improvements.
This cost does NOT include the cost of easement nor right-of-way acquisition, if needed.

A description of the services to be performed is as follows:
DESIGN PHASE:
The Engineer will proceed with the performance of services in this phase as follows:
1, Establish the scope of any field survey investigations that may be necessary for
the design of the Project, and with the Town's approval, arrange for such
surveys to be conducted for the Town's account, and assist in interpreting the
results.
2. Prepare construction plans and specifications, and contract documents for the
improvements to be constructed;
3. Identify any necessary easements and/or right-of-way needed. Procurement of
necessary easement/right-of-way will be an additional service;
d. Prepare detailed cost projections and bidder's proposal forms of the
improvements to be constructed;
5. Furnish three (3) sets of copies of plans, specifications, and bidding documents
to the Town for review and approval.
ADDITIONAL SERVICES:
1. Printing of all plans and specifications required, which would be in addition to
the three (3) sets to be furnished as described above.
2. Provide design surveying services, if needed, as distinguished from the
surveying services described above and contracted separately by the Town.
3. Boundary survey and documents for easement and/or right -of --way acquisition,
if needed.
BIDDING PHASE:
The Engineer will proceed with the performance of services in this phase as follows:
1. Assist the Town in securing bids, issuing notice to bidders, and notifying
construction news publications. The notice to bidders will be furnished to the
Town for publication in the local news media.
2. Assist the Town in the opening, tabulation, and analysis of the bids received,
and furnish recommendations- on the award of contract or the appropriate
actions to be taken by the Town.
CONSTRUCTIONREVIEW PHASE:
After award of contract, the Engineer will proceed with the following general review
of construction services:
1. Assist in the preparation of formal contract documents for construction
contract.
2. Assist in conducting pre -construction conference with the contractor.
3. Make periodic visits to the site (as distinguished from the continuous services
of a Resident Project Representative) to observe the progress and the quality of
work and to attempt to determine in general if the work is proceeding in
accordance with the contract documents- In performing these services, the
Engineer will endeavor to protect the Town against defects and deficiencies in
the work of contractors; the Engineer will report any observed defects or
deficiencies immediately to the Town; however, it is understood that the
Engineer does not guarantee the contractor's performance nor is he responsible
for supervision of the contractor's operation and employees.
4. Consult and advise with the Town during construction, make recommendations
to the Town regarding the materials and workmanship, and prepare change
orders with the Town's approval.
5. Check and review samples, catalog data, schedules, shop drawings, laboratory,
shop and mill tests of material and equipment and other data which the
contractor is required to submit for conformance with the design concept of the
Project and compliance with the information given by the contract documents.
6. Assist the Town in arranging for testing of materials and laboratory control
during construction to be conducted at the Town's expense, and assist in
interpreting the results of such tests.
7. Interpret intent of the plans and specifications for the Town and contractor.
8. Prepare monthly and final estimates for payment to the contractor.
9. Conduct, in company with the Town's representative, a final inspection of the
Project for conformance with the design concept of the Project and compliance
with the contract documents, and review and comment on the certificate of
completion and the recommendation for final payment to the contractor.
10. Prepare revisions of construction drawings with the assistance of the Town
Project personnel and the construction contractor, reflecting changes in the
Project made during construction. The Engineer shall provide these "Record
Drawings" to the Town as one set of reproducible sheets and two sets of prints.
ADDITIONAL SERVICES:
Additional services to be performed by the Engineer, if authorized by the Town, which
are not included in the above described basic services, are described as follows.
1. Printing of all final plans and specifications over and above those paid for by
bidders and/or contractors.
2. Providing shop, mill, and field or laboratory inspection of materials and
equipment.
3. Preparation of any required Operation and 'Maintenance Manuals or conducting
operator training, and preparation of Environmental Impact Assessments or
Statements.
4. Appearance before regulatory agencies or courts as an expert witness in any
litigation with third parties or condemnation proceedings arising from the
development or construction of the Project including the preparation of
engineering data and reports for assistance to the Town.
5. Furnishing the services of a Resident Project Representative to act as the
Town's on-site Representative during the construction phase, if requested by
the Town.
BASIS OF COMPENSATION:
I . Availability of Funds
The Town agrees that funds, to the extent required, are currently available and
sufficient to complete the proposod engineering services authorized under this
Proposal. - All invoices submitted by the Engineer and approved by the Town
shall be paid within thirty (30) days of the invoice date. For any payments not
made within thirty (30) days, a charge will be made monthly in the amount of
one and one-half percent (1-1/2%) of the unpaid balance, beginning thirty (30)
days from the date of the statements.
2. Design Phase
The total compensation for the Design, Bidding, and Construction Review
Phase Services will be on a lump sum basis. The Town shall make payments
to the Engineer for performing the engineering services described on a monthly
billing basis in proportion to that part of the services proposed therein which
has been accomplished, as evidenced by monthly statements submitted by the
Engineer and approved by the Town. Final payment shall be due upon
completion of the services described.
The lump sum amounts for each phase shall be as follows:
Design Phase $ 21,500
Bidding Phase $ 1,500
Construction Review $ 4,000
Total $ 27,000
3. Additional Services
For performing any required services described in Additional Services above,
the Engineer is to be paid on a monthly billing basis at the per diem rates of
personnel's salary cost times a multiplier of 2.5, with all direct non -labor and
subcontract expenses to be reimbursed at invoice cost plus 10% for handling.
It is projected that Field Surveying Services for design will not exceed
$9,800.00 and GPS Services will not exceed $1,800.00. Easement and/or
right-of-way documents, if needed, can be provided for an additional fee.
TIME FOR COMPLETION:
The Engineer will work expeditiously to complete all of the services described herein
in the shortest length of time possible. The time projected for substantially completing
the Design Phase Services is sixty (60) calendar days after receipt of field survey data
for design. The completion time for the Bidding Phase Services is approximately
thirty (30) days after authorization to advertise is issued by the Town, while the
Construction Review Phase Services are projected to be one hundred and twenty (120)
days. The above mentioned times do not account for delays related to acquisition of
easements or rights-of-way, or any other delays which are not within the control of the
Town or Engineer.
This Letter Proposal is being submitted in two (2) counterparts. If it meets with your
approval, please execute both copies in the spaces provided, retain one (1) copy for your files,
and return one (1) copy to our office.
We certainly appreciate the privilege of performing these services for you.
