HomeMy WebLinkAboutOrd 420 Adopting provisions eliminating architectural barriers for persons with disabilities TOWN OF WESTLAKE ORDINANCE NO. 420 AN ORDINANCE ADOPTING THE PROVISIONS OF ARTICLE 9102, TEXAS REVISED CIVIL STATUTES, RELATING TO THE REVIEW OF PLANS AND SPECIFICATIONS FOR THE PURPOSE OF ELIMINATING ARCHITECTURAL BARRIERS ENCOUNTERED BY PERSONS WITH DISABILITIES; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES; PROVIDING A SEVERABILITY CLAUSE AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Town of Westlake, Texas is taking this action to comply with Senate Bill 484 as enacted by the 2001 Legislative session, requiring property owners to submit their building plans for new construction and remodeling of public and most private commercial buildings, where costs exceed $50,000.00 to the Texas Department of Licensing and Regulation ("TDLR-") prior to comrrencerr.ent of construction or issuance of a Town building permit; and WHEREAS, Senate Bill 484, Section K of Article 9102, Texas Revised Civil Statutes, places the following requirement gn Towns: "A public official of a political subdivision who is legally authorized to issue building construction permits may not accept an application for a building construction permit for a building or a facility subject to subsection (j) of this section unless the official verifies that the building or facility has been registered with TDLR as provided by rule." NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OFT E TOWN OF WESTLAKE, TEXAS, THAT: SECTION 1: The Town of Westlake.. Texas., hereby adopts the provisions of Senate Bill 484, Article 9102, Texas Revised Civil Statutes. SECTION 2: Upon the adoption of this ordinance the Town of Westlake, in compliance with Senate Bill 484, shall not issue building permits on new construction or remodeling projects, where the costs exceed $50,000, unless the applicant has first registered the new construction or remodeling project with the TDLR. SECTION 3: Any violation of this Ordinance is subject to the maximum fine permitted under the laws of the State of Texas for violations of a municipal ordinance governing the public health and sanitation and safety of the Town. In the event that it is determined that this Ordinance does not constitute the governing of public health and sanitation and safety, or the maximum fine is set by state law, than a violation of this Ordinance is subject to the maximum fine permitted under the laws of the State of Texas for violation of town ordinances or set by state law. SECTION 4: It is hereby declared to be the intention of the Board of Aldermen that the phrases, clauses, sentences, paragraphs and sections of this ordinance are severable, and if any phrase, clause. sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the Board of Aldermen without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 5: This ordinance shall be cumulative of all provisions of ordinances of the Town of Westlake, Texas, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances, in which event the conflicting provisions of such ordinances are hereby repealed. SECTION 6: This Ordinance shall become effective from and after the date of its passage. All pending development applications and proposals shall be processed in accordance with the standards and requirements and pursuant to the procedures established by this Ordinance.
