HomeMy WebLinkAboutRes 00-25 Authorizing Expenditures for Economic DevelopmentTOWN OF WESTLAKE RESOLUTION NO. 00-25 A RESOLUTION OF THE TOWN OF WESTLAKE, TEXAS, AUTHORIZING THE EXPENDITURE OF CERTAIN SALES TAX REVENUES FOR ECONOMIC DEVELOPMENT TO PAY FOR A WATER AND WASTEWATER RATE STUDY AS PREVIOUSLY RECOMMENDED BY THE 4B ECONOMIC DEVELOPMENT CORPORATION AND AS AUTHORIZED BY TEX. REV. CIV. STAT. ANN. §5190.6; AUTHORIZING THE REIMBURSEMENT OF THE GENERAL FUND FROM THE 4B ECONOMIC DEVELOPMENT SALES TAX FUND FOR CERTAIN EXPENDITURES WHICH ARE ELIGIBLE AND AUTHORIZED BY TEX. REV. CIV. STAT. ANN. §5190.6; PROVIDING FOR AN EFFECTIVE DATE; AND PROVIDING A SAVINGS CLAUSE WHEREAS, economic development is vital to the Town of Westlake, Texas (the "Town"); and WHEREAS, the rapid development currently proceeding within the Town necessitates the Town provide adequate and efficient water and wastewater utilities; and WHEREAS, a vital component to the enhancement of economic development within the Town is to implement the necessary water and wastewater infrastructure; and WHEREAS, the Town must obtain the necessary and adequate rate structure to be utilized for the use of its water and wastewater services; and WHEREAS, on April 10, 2000, the 4B Economic Development Corporation authorized the expenditure as approved by this Resolution. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE TOWN OF WESTLAKE, TEXAS: Section 1. That all matters stated in the preamble are found to be true and correct and are incorporated herein as if copied in their entirety. Section 2. That the use of the one-half (112) cent sales tax revenues (the "411 Tax") pursuant to Section 4B of Tex. Rev. Civ. Stat. Ann. §5190.6 (the "Act"), for the purposes contained in this Resolution, are for an authorized project as defined by the Act. Section 3. That the Town Manager is authorized to expend the 4B Tax in an amount not to exceed $32,000.00 to pay the consulting firm of Perez/Freese & Nichols for professional services involved in a water and wastewater rate study. Section 4. That the Town Manager is authorized to reimburse the Town's general fund in an amount not to exceed $20,206.43 from the 4B Tax, within the limits set forth in Section 3, for monies already expended for the water and wastewater study which is authorized by the Act. Section 5. If any provision of this Resolution shall be held invalid or unconstitutional, then the remainder of such Resolution shall remain in full force and effect as if separately enacted.
