HomeMy WebLinkAboutOrd 956 Town Secretary Reporting StructureTOWN OF WESTLAKE ORDINANCE NO. 956 AN ORDINANCE OF THE TOWN OF WESTLAKE AMENDING THE CODE OF ORDINANCES BY AMENDING CHAPTER 2 ADMINISTRATION, SECTION 2- 163(b)(1), AND SECTION 2-163(b)(2), TOWN SECRETARY REPORTING AND COMPENSATION; PROVIDING A CUMULATIVE, REPEALER AND SEVERABILITY CLAUSE; AUTHORIZING PUBLICATION; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the Town of Westlake, Texas is a general law Town; and WHEREAS, the Town Council hereby recommends amending Section 2-163(b)(1) that the Town Secretary shall report to the Town Council; and WHEREAS, the Town Council hereby recommends amending Section 2-163(b)(2) that the Town Council shall fix the compensation of the Town Secretary and the Town Secretary's compensation may be amended, from time to time, in accordance with the town secretary's experience, qualifications and performance. WHEREAS, the Town Council finds it is in the best interests of the town and its citizens that the amendments should be approved and adopted. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF WESTLAKE, TEXAS: SECTION 1: That all matters stated in the preamble are found to be true and correct and are incorporated herein as if copied in their entirety. SECTION 2: That Chapter 2 of the Town of Westlake Code of Ordinances, as amended, is hereby amended as follows. Chapter 2 - ADMINISTRATION Sec. 2.163 Town Secretary b. Reporting and Compensation. 1) The Town Secretary shall report to the Town Council. 2) The Town Council shall fix the compensation of the Town Secretary, and the Town Secretary's compensation may be amended, from time to time, in accordance with the Town Secretary's experience, qualifications and performance. Ordinance 956 Page I of 2 SECTION 3: That the recitals contained in the preamble hereof are hereby found to the true, and such recitals are hereby made a part of this Ordinance for all purposes and are adopted as a part of the judgement and findings of the Council. SECTION 4: That this Ordinance shall be cumulative of all other Town Ordinances and all other provisions of other Ordinances adopted by the Town which are inconsistent with the terms or provisions of this Ordinance are hereby repealed. SECTION 5: It is hereby declared to be the intention of the Town Council of the Town of Westlake, Texas, that sections, paragraphs, clauses and phrases of this Ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this Ordinance shall be declared legally invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such legal invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs or sections of this Ordinance since the same would have been enacted by the Town Council of the Town of Westlake without the incorporation in this Ordinance of any such legally invalid or unconstitutional, phrase, sentence, paragraph or section. SECTION 6: That publishers of the City Code are authorized to amend said Code to reflect the changes adopted herein and to correct typographical errors and to format and number paragraphs to conform to the existing Code. SECTION 7: This ordinance shall take effect immediately from and after its passage as the law in such case provides. PASSED AND APPROVED ON THIS 14th DAY OF NOVEMBER 2022. ATTEST: Amy M.
