HomeMy WebLinkAboutOrd 400 Amending Fee and Use ScheduleTOWN OF WESTLAKE ORDINANCE NO. 400 AN ORDINANCE OF THE TOWN OF WESTLAKE, TEXAS, AMENDING ORDINANCE NO. 395 WHICH AMENDED THE COMPREHENSIVE FEE AND MUNICIPAL USE SCHEDULE AS ADOPTED BY ORDINANCE NO. 379, TO ADD A RESIDENTIAL LOT DEVELOPMENT FEE APPLICABLE TO RESIDENTIAL SUBDIVISIONS CONTAINING ANY PORTION OF THE TOWN DUCT BANK; REPEALING ALL PROVISIONS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR AN EFFECTIVE, DATE WHEREAS, in order to provide for effective and efficient municipal services for the health, safety and welfare of the citizens of the Town of Westlake, the Town has adopted a Fee and Municipal Use Schedule; and WHEREAS, the amendments to the Fee and Municipal Use Schedule are necessary to preserve and protect the health, safety and welfare of the citizens of the Town of Westlake. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE TOWN OF WESTLAKE, TEXAS: SECTION 1: That the above i ndings are hereby deemed true and correct and adopted into the body of this Ordinance in their entirety. SECTION 2: That Ordinance No. 395 which amended the Town of Westlake Municipal Fee and Use Schedule is hereby amended as follows: "All newly -constructed resicenfial structures contained within a platted subdivision containing any portion of the Town owned utility duct bank shall pay a $2,260.00 Residential Lot Development Fee per lot, in addition to the Building Permit Fees. The Residential Lot Development Fee shall be payable in conjunction with the Building Permit Fee." SECTION 3: That all other provisions of Ordinances No. 379 and 395 not hereby amended shall remain unchanged and i:i full force and effect. SECTION 4: If any portion of this Ordinance shall, for any reason, be declared invalid by any court or competent jurisdiction, such invalidity shall not affect the remaining provisions hereof and the Board hereby determines that it would have adopted this Ordinance without the invalid provision. SECTION 5: That all other provisions of other ordinances adopted by the Town which are inconsistent with the terms or provisions of this Ordinance are hereby repealed. SECTION 6: This Ordinance diall take effect immediately from and after its passage. PASSED AND APPROVED THIS 241" DAY OF SEPTEMBER, 2001.
