ORDINANCE NO. 396
AN ORDINANCE OF THE TOWN OF WESTLAKE, TEXAS, AMENDING ARTICLE
XIII, SUBDIVISIONS, SECTION 3.4, ISSUANCE OF BUILDING PERMITS AND
CERTIFICATES, OF THE UNIFIED DEVELOPMENT CODE RELATING TO
BUILDING PERMITS; PROVIDING PROVISIONS FOR A SALES TAX SITUS
AGREEMENT; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS
CLAUSE; PROVIDING A PENALTY CLAUSE; PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, the provision for procuring additional sales tax revenue for the Town of
Westlake, Texas (the "Town") is of vital importance to the health, safety and welfare of the
citizens of the Town; and
WHEREAS, establishing reasonable requirements for the timely procurement of sales
tax revenue are also of vital importance to the health, safety and welfare of the citizens of the
Town; and
WHEREAS, the Town desires to ensure all reasonable efforts are taken to procure sales
tax revenue.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
TOWN OF WESTLAKE, TEXAS:
SECTION 1: That Article XIII, Subdivisions, Section 3.4.A Building Permit, be
amended by adding the following:
"No commercial building permit shall be issued until a sales tax situs agreement has been
executed, unless a waiver of the agreement is approved by the Town."
SECTION 2: If any portion of this Ordinance shall, for any reason, be declared invalid
by any court or competent jurisdiction, such invalidity shall not affect the remaining provisions
hereof and the Board hereby determines that it would have adopted this Ordinance without the
invalid provision.
SECTION 3: That this Ordinance shall be cumulative of all other Town Ordinances and
all other provisions of other Ordinances adopted by the Town which are inconsistent with the
terms or provisions of this Ordinance are hereby repealed.
SECTION 4: Any person who violates any provision of this ordinance shall be deemed
guilty of a misdemeanor and shall be punished by a fine of not less than five hundred ($500.00)
dollars. If a violation continues, each day's violation shall be deemed a separate offense.
SECTION 5: This Ordinance shall take effect immediately from and after its passage.
