HomeMy WebLinkAboutOrd 424 Amending the Fee and Use Schedule regarding Ambulance FeesTOWN OF WESTLAKE ORDINANCE NO. 424 AN ORDINANCE OF THE TOWN OF WESTLAKE, TEXAS, AMENDING ORDINANCE NO. 379 RELATING TO AMBULANCE SERVICE FEES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, on September 25, 2000, the Town of Westlake, Texas adopted Ordinance No. 379 which approved the comprehensive fee and municipal fee schedule; and WHEREAS, subsequent to the passage of Ordinance No. 379, the Town of Westlake commenced providing emergency medical service; and WHEREAS, the Board of Aldermen determines that it is in the best interest of the citizens of Westlake to adopt a fee for emergency medical services provided by the Town. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE TOWN OF WESTLAKE, TEXAS: SECTION 1: All matters stated in the preamble are hereby found to be true and correct and are incorporated herein by reference as if copied in their entirety. SECTION 2: That the Town of Westlake Municipal Fee and Use Schedule is hereby amended by the addition of the following: "Ambulance and EMS Fees: BLS Emergency: $400.00 ALS I: $500.00 ALS 11: $700.00 Mileage: $.10 per mile" All other provisions of Ordinance 379 remain unchanged. SECTION 3 It is hereby declared to be the intention of the Board of Aldermen that the phrases, clauses, sentences, paragraphs and sections of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the Board of Aldermen without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 4: This ordinance shall be cumulative of all provisions of ordinances of the Town of Westlake, Texas, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances, in which event the conflicting provisions of such ordinances are hereby repealed. SECTION 5: This Ordinance shall become effective from and after the date of its passage. PASSED AND APPROVED ON THIS 26" DAY OF AUGUST, 2002.
