HomeMy WebLinkAboutOrd 419 Adopting the 2000 International Residential Building CodeTOWN OF WESTLAKE ORDINANCE NO. 419 AN ORDINANCE ADOPTING THE YEAR 2000 EDITION OF THE INTERNATIONAL RESIDENTIAL BUILDING CODE IN ACCORDANCE WITH CHAPTER 214G OF THE LOCAL GOVERNMENT CODE; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES; PROVIDING A SEVERABILITY CLAUSE AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Town of Westlake, Texas in compliance with Senate Bill 365 as enacted by the 2001 Legislative session, does adopt the year 2000 edition of the International Residential Building Code (IRC) for one and two family dwellings; and WHEREAS, the IRC shall be used for regulating the design, construction, quality of materials, erection, installation, alteration, repair, location, relocation, replacement, addition to, use or maintenance of one and two family dwellings and townhouses not more that three stories in height, and providing for the issuance of permits and collection of fees thereof: NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE TOWN OF WESTLAKE, TEXAS, THAT: SECTION 1: The Town of Westlake, Texas in compliance with SB 365 hereby adopts the 2000 edition of the International Residential Building Code, SECTION 2: Any violation of this Ordinance is subject to the maximum fine permitted under the laws of the State of Texas for violations of a municipal ordinance governing the public health and sanitation and safety of the Town. In the event that it is determined that this Ordinance does not constitute the governing of public health and sanitation and safety, or the maximum fine is set by state law, than a violation of this Ordinance is subject to the maximum fine permitted under the laws of the State of Texas for violation of town ordinances or set by state law. SECTION 3 It is hereby declared to be the intention of the Board of Aldermen that the phrases, clauses, sentences, paragraphs and sections of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the Board of Aldermen without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. direct conflict with the provisions of such ordinances, in which event the conflicting provisions of such ordinances are hereby repealed. SECTION 5: This Ordinance shall become effective from and after the date of its passage. All pending development applications and proposals shall be processed in accordance with the standards and requirements and pursuant to the procedures established by this Ordinance.
