HomeMy WebLinkAboutWA Resolution 22-35 Regarding Organization of Westlake AcademyRESOLUTION 22-35 REGARDING ORGANIZATION OF WESTLAKE ACADEMY WHEREAS, the Town of Westlake is the charter holder for Westlake Academy ("Academy"), an open -enrollment charter school authorized by the Texas Education Agency ("TEA"), and the Town Council serves as the governing body of the charter holder and the governing body for the Academy; and WHEREAS, under Texas Education Code Section 12.102, an open -enrollment charter school is governed under the governing structure described by the charter; and WHEREAS, TEA renewed the terms and conditions between TEA and the Town of Westlake for the operation of the Academy in an Agreement dated July 5, 2016, and such Agreement incorporates the information and documents in the Academy's 2015 renewal application; and WHEREAS, the charter school organizational chart and other information submitted with the Academy's 2015 renewal application identifies the Town Manager as the superintendent for the Academy, which includes serving as the chief executive officer for the Academy as defined in the Texas Administrative Code; and WHEREAS, the Town Council desires to amend the current charter as necessary to revise the organizational structure of the Academy regarding the position directly responsible to the Town Council as the chief executive officer of the Academy and to identify such position as Head of School for the Academy; and WHEREAS, the Town Council is of the opinion and finds that it is in the best interest of the students of Westlake Academy to amend the organizational structure of the Academy as identified herein; NOW THEREFORE, BE IT RESOLVED, that the statements contained in the preamble of this Resolution are true and correct and adopted as findings of fact and operative provisions hereof. BE IT FURTHER RESOLVED that, subject to approval by TEA, the Academy shall adopt an organization chart that identifies the Head of School for the Academy as reporting directly to the Town Council and serving as the educational leader and chief executive officer for the Academy, and further identifies the Town Manager as an advisor to the Town Council related to its role as the governing body for the Academy. BE IT FURTHER RESOLVED that the Town Manager is authorized to submit a Non - Expansion Amendment Request Form to TEA on behalf of the Academy to facilitate the charter amendment request identified herein. Subject to any approval that may be required by TEA for certain actions identified herein, this Resolution shall be in full force and effect from and after its passage, and it is so resolved.
