HomeMy WebLinkAboutRes 04-59 Authorizing an Agreement with the City of Keller for Electronic Ticket WritersTOWN OF WESTLAKE RESOLUTION NO. 04-59 A RESOLUTION OF THE BOARD OF ALDERMEN OF THE TOWN OF WESTLAKE, TEXAS, AUTHORIZING THE TOWN MANAGER TO ENTER INTO A TWENTY-FOUR MONTH AGREEMENT WITH THE CITY OF KELLER TO PROVIDE HANDHELD ELECTRONIC TICKET WRITERS, AUTHORIZING THE TOWN MANAGER TO EXECUTE SAID AGREEMENT ON BEHALF OF THE TOWN OF WESTLAKE, TEXAS. WHEREAS, Citations need to be issued within the Town of Westlake to control the speed of vehicles and ensure the safety of the residents, visitors and other drivers; and WHEREAS, The City of Keller will provide the electronic ticket writers and all maintenance of hardware and software to the units for the Town of Westlake; and WHEREAS, Attached is an agreement establishing the services provided with this maintenance agreement; and WHEREAS, the Mayor and Board of Aldermen of the Town of Westlake, Texas, as well as the Town Staff, have been committed to providing a safe environment for its residents and visitors and hereby deem it to be of the utmost importance to the Town of Westlake and the City of Keller to actively participate and heretofore execute said Agreement. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN TO THE TOWN OF WESTLAKE, TEXAS: SECTION 1: The above findings are hereby found to be true and correct and are incorporated herein in the entirety. SECTION 2: The Board of Aldermen of the Town of Westlake, Texas, hereby approve the Agreement with the City of Keller, relating to the use of electronic ticket writers, attached hereto as Exhibit "A"; and further authorizes the Town Manager to execute said agreement on behalf of the Town of Westlake, Texas. SECTION 3: The annual cost as per said agreement, $6,394.00 for the first year and $3,164.00 for the second year, has been calculated in the 2004/2005 and 2005/2006 budget. SECTION 4: The Town of Westlake's annual participation dues shall be paid for from the Municipal Court Technology Fund and included in the FY 2004-2005 and 2005/2006 budget. Petty, To vlanager This Agreement is made and entered in to by the City of Keller, Texas, a Home Rule municipal corporation, and the Town of Westlake, Texas, a Type A General Law municipal corporation, each acting by and through it duly appointed city manager. WHEREAS, The Town of Westlake hereby agrees to lease two (2) handheld iPAQ 555 traffic citation (handheld) writers and mobile printers to be utilized by the City of Keller Police Department Motorcycle Officers assigned to the Town of Westlake pursuant to the Police Services Agreement between the City of Keller and the Town of Westlake. Included in this agreement is the software, installation, accidental damage protection, and training costs associated with the handheld ticket writers. The Town of Westlake will be responsible to provide the pre-printed citations and court software interface to receive the date from the traffic officers over Internet e-mail. Term. The term of this lease agreement shall be two years, beginning October 1, 2004 and* Payment. The first year's payment of $6,394.00 shall be payable in four equal quarterly payments of $1598.50 each with the first payment due on October 1, 2004, and subsequent quarterly payments due on the first day of the beginning of each calendar quarter thereafter and ending with third calendar quarter of the first payment year. The second year's 'payment of $3,164.00 shall be payment in four equal quarterly first payment due on October 1, 2005 and subsequent payments of $791-00 each with the quarterly payments due on the first day of the beginning of each calendar quarter thereafter and ending with the third calendar quarter of the second payment year. Equipment. During the term of this Agreement and continuing after the expiration of this Agreement, the equipment will be owned and maintained by the City of Keller. Cancellation. Either party shall have the right to terminate this Agreement by giving written notice to the other party at least ninety (90) days prior to the date of termination.
