RESOLUTION NO.22-30
A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF WESTLAKE,
TEXAS, DECLARING AN EMERGENCY AND AUTHORIZING THE AGREEMENT
WITH VENTURE MECHANICAL TO REPLACE THE 15-TON SPLIT SYSTEM IN
THE GYM BUILDING AT THE WESTLAKE ACADEMY CAMPUS. AND
AUTHORIZE THE TOWN MANAGER TO MAKE FUNDING CHANGES NOT TO
EXCEED $25,000 ON THIS PROJECT.
WHEREAS, the Town of Westlake owns and operates the Westlake Academy and provides
facilities for Town and Academy use; and,
WHEREAS, the 15- ton split system was installed in 2003 in the Gym buildings; and,
WHEREAS; the unit supplies AC to the dining hall and classes on the lower level of the gym
which failed; and,
WHEREAS, the unit needs to be replaced and there is a 13-week lead time on getting all of the
parts and materials for the units; and,
WHEREAS, the execution of the $69,500.00 is necessary and continues an emergency; and,
WHEREAS, the service meets best value for the replacement and the bid requirement for the
state of Texas; and,
WHEREAS, the Town Council finds that the passage of this resolution is in the best
interest of the citizens of Westlake.
NOW; THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE
N TOWOF WESTLAKE, TEXAS:
SECTION L. That, all matters stated in the Recitals hereinabove are found to be
true and correct and are incorporated herein by reference as if copied in their entirety.
SECTION 2: That the Town of Westlake Town Council hereby deem execution of
$69,500.00 to be an emergency for the approval of the agreement with Venture Mechanical.
as attached as Exhibit "A" and authorize Town Manager to make funding changes not
to exceed $25,000 on this project., attached as Exhibit "A".
SECTION 3: Ifany portion of this Resolution shall, for any reason, be declared
invalid by any court of competent jurisdiction, such invalidity shall not affect the
remaining provisions hereof and the Council hereby determines that it would have adopted
this Resolution without the invalid provision.

passage.

SPLIT SYSTEM REPLACEMENT PRICING
Mr. Meyer,
We are pleased to present the following quotation to furnish the necessary labor and material to
replace (1) 15-ton split system for the above referenced project as follows: 13-week lead time on
Carrier Split System.
Bid Clarifications
• Provide labor on normal working hours
• Provide (1) Carrier 15-ton condnesing unit, 460-volt 3-phase with dual refrigerant circuit,
and provide (1) new refirgerant piping for new circuit with new insualtion and aluminum
jacketing, instal new liqid lines dryers and leak test
• Provide (1) Carrier 15- ton air handler with DX cooling with hot water heating,
disconnect/reconnect to existing ductwork and drain line, installl new auxiliary drain pan
under new air handler with float switch
• Provide fire sprinkler pipe remove/reinstall
• Provide hoisting to set new unit and dispose of old unit
• Disconnect/Reconnect to existing electrical and drain lines
• Remove/Reinstall (2) hot water pumps and piping and reinstall and insulate as necessary
• Provide electrical to disconnect/reconnect air handler, condensing unit, and pumps
• Provide Logical Solution Controls to disconnect/reconnect
• Remove and reinstall ductwork and provide filter section for accessibility
• Provide Carrier startup procedures
• City of Westlake MEP permits (NO COST INCLUDED)
• Provide (1) year warranty parts and labor with an additional (4) years on compressor
from Carrier (PART ONLY)
Total cost (includes tax) - - - - - $69,500.00
Exclusions: Overtime, sales tax will be added if not tax exempt, permit fees. Repairs
not in above scope. Existing valves not holding. Temporary heating or cooling.
Equipment of storage, equipment warranty.

A governmental entity may not enter into a contract with a company for goods or services unless the contract contains a written
verification from the company that it:
(1) does not boycott Israel; and
(2) will not boycott Israel during the term of the contract.
The following definitions apply:
(1) "Boycott Israel" means refusing to deal with, terminating business activities with, or otherwise taking any action that is
intended to penalize, inflict economic harm on, or limit commercial relations specifically with Israel, or with a person or entity doing
business in Israel or in an Israeli -controlled territory, but does not include an action made for ordinary business purposes.
(2) "Company" means a for -profit sole proprietorship, organization, association, corporation, partnership, joint venture,
