HomeMy WebLinkAboutOrd 464 Amending Ordinance 415 appointing the Town MarshalTOWN OF WESTLAKE ORDINANCE NO. 464 AN ORDINANCE AMENDING ORDINANCE 415 OF THE TOWN OF WESTLAKE, TEXAS, APPOINTING THE TOWN MARSHAL; PROVIDING FOR THE DUTIES AND QUALIFICATIONS OF THE TOWN MARSHAL; PROVIDING FOR THE DUTIES AND QUALIFICATIONS OF ANY DULY APPOINTED DEPUTIES TO THE TOWN MARSHAL; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE, WHEREAS, the Town of Westlake is authorized to appoint a Town Marshal pursuant to Sections 341.021 and 22.071 of the Local Government Code; and WHEREAS, the Town Marshal shall perform the duties of office as provided for in Section 341.021 of the Local Government Code, and as otherwise prescribed by law; and WHEREAS, the Board of Aldermen determines that it is in the best interest of the citizens of Westlake to appoint a Town Marshal. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE TOWN OF WESTLAKE, TEXAS: SECTION 1: All matters stated in the preamble are hereby found to be true and correct and are incorporated herein by reference as if copied in their entirety. SECTION 2: The office of Town Marshal is hereby created pursuant to Section 341.021 of the Local Government Code. The Town Marshal shall have all authority to serve as provided for in State law. The Town Marshal must meet all qualifications of State law for this office. SECTION 3: The Town Marshal shall execute a bond as required by State Law and swear to an oath of office as required by State law. SECTION 4: The Town Marshal shall act under the direction of the Court Administrator, and shall perform the following duties: A. Execute warrants, subpoenas, and other legal process issuing out of the Town of Westlake Municipal Court of Record No. 1, as determined by the Court Administrator. B. Execute other warrants of arrest, subpoenas, and legal process as authorized by law and as determined by the Court Administrator. C. Serve as the court bailiff to the Town of Westlake Municipal Court of Record No. 1. D. Any other duties authorized by State law and assigned by the Municipal Court Judge or the Court Administrator. SECTION 5: The Town Manager shall appoint the Town Marshal and said position shall be included by the Town Manager in the annual budget to be considered by the Board of Aldermen for the Town of Westlake. SECTION 6: The Town reserves the right to establish duties and positions to support the deputies to the Town Marshal to function under the policies and procedures adopted for said position by the Town of Westlake. SECTION 7: This Ordinance shall be cumulative of all other Ordinances and shall not repeal any of the provisions of such Ordinances except for those instances where there are direct conflicts with the provisions of this Ordinance. Ordinances or parts thereof in force at the time this Ordinance shall take effect and that are inconsistent with this Ordinance are hereby repealed to the extent that they are inconsistent with this Ordinance. SECTION 8: If any section, article, paragraph, sentence, clause, phrase or word in this Ordinance, or application thereof to any person or circumstance, is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of the Ordinance, and the Board of Aldermen hereby declares it would have passed such remaining of the Ordinance despite such invalidity, which remaining portions shall remain in full force and effect. SECTION 9: All other Ordinances in effect and not in conflict with the Ordinance shall remain in full force and effect. SECTION 10: The Town Secretary of the Town of Westlake is hereby directed to engross and enroll this Ordinance by copying the exact Caption and Effective Date clause in the minutes of the Town Council of the Town of Westlake and by filing this Ordinance in the Ordinance records of the Town. SECTION 11: This Ordinance shall take effect from and after its date of passage in accordance with law, and it is so ordained. PASSED AND APPROVED THIS 22"d DAY OF NOVEMBER 2004.
