HomeMy WebLinkAboutOrd 450 Amending the Comprehensive Plan Adopting a new Land Use MapTOWN OF WESTLAKE ORDINANCE NO. 450 AN ORDINANCE OF THE TOWN OF WESTLAKE, TEXAS, AMENDING THE COMPREHENSIVE PLAN FOR THE TOWN TO ADOPT A NEW LAND USE MAP; PROVIDING FOR A SEVERABILITY CLAUSE; PROVIDING FOR A SAVINGS CLAUSE; AND DECLARING AN EFFECTIVE DATE. WHEREAS, on August 24, 1992, Westlake, Texas (the "Town") adopted a Plan") for the Town; and the Board of Aldermen (the "Board") of Comprehensive Plan (the "Comprehensive WHEREAS, the Town desires to amend the Comprehensive Plan to adopt a new Land Use Map (the "Land Use Map") in accordance with the provisions of Chapter 213 of the Texas Local Government Code; and WHEREAS, t he Planning a nd Zoning C ommission o f t he T own he Id a dul y - called and noticed public hearing on the herein described amendments to the Comprehensive Plan on February 26, 2004;.and WHEREAS, the Planning and Zoning Commission of the Town has recommended to the Board that the hereinafter described Land Use Plan be adopted; and WHEREAS, the Board believes that the interests of the Town, the present and future residents and citizens of the Town, and developers of land within the Town are best served by the adopting of this Ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE TOWN OF WESTLAKE, TEXAS: SECTION 1: That the recitals set forth above and hereby incorporated herein, adopted and declared to be true and correct. SECTION 2: That the Comprehensive Plan is hereby amended to adopt the Land Use Map as attached hereto as Exhibit "A", which said Exhibit is incorporated herein for all purposes. SECTION 3: That the Land Use Map shall contain the following notation in compliance with Section 213.005 of the Texas Local Government Code: "A comprehensive Plan shall not constitute zoning regulations or establish zoning district boundaries." SECTION 4: It is hereby declared to be the intention of the Board of Aldermen of the Town of Westlake, Texas, that sections, paragraphs, clauses and phrases of this Ordinance are severable, and if any phrase, clause, sentence, paragraph, or section of this Ordinance shall be declared unconstitutional or illegal by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality or illegality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, or sections of this Ordinance since the same would have been enacted by the Board of Alderman of the Town of Westlake without the incorporation in this Ordinance of any such unconstitutional or illegal phrase, clause, sentence, paragraph, or section.
