ORDINANCE NO. 450
AN ORDINANCE OF THE TOWN OF WESTLAKE, TEXAS, AMENDING THE
COMPREHENSIVE PLAN FOR THE TOWN TO ADOPT A NEW LAND USE
MAP; PROVIDING FOR A SEVERABILITY CLAUSE; PROVIDING FOR A
SAVINGS CLAUSE; AND DECLARING AN EFFECTIVE DATE.
WHEREAS, on August 24, 1992,
Westlake, Texas (the "Town") adopted a
Plan") for the Town; and
the Board of Aldermen (the "Board") of
Comprehensive Plan (the "Comprehensive
WHEREAS, the Town desires to amend the Comprehensive Plan to adopt a new
Land Use Map (the "Land Use Map") in accordance with the provisions of Chapter 213
of the Texas Local Government Code; and
WHEREAS, t he Planning a nd Zoning C ommission o f t he T own he Id a dul y -
called and noticed public hearing on the herein described amendments to the
Comprehensive Plan on February 26, 2004;.and
WHEREAS, the Planning and Zoning Commission of the Town has
recommended to the Board that the hereinafter described Land Use Plan be adopted; and
WHEREAS, the Board believes that the interests of the Town, the present and
future residents and citizens of the Town, and developers of land within the Town are
best served by the adopting of this Ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
ALDERMEN OF THE TOWN OF WESTLAKE, TEXAS:
SECTION 1: That the recitals set forth above and hereby incorporated herein,
adopted and declared to be true and correct.
SECTION 2: That the Comprehensive Plan is hereby amended to adopt the Land
Use Map as attached hereto as Exhibit "A", which said Exhibit is incorporated herein for
all purposes.
SECTION 3: That the Land Use Map shall contain the following notation in
compliance with Section 213.005 of the Texas Local Government Code:
"A comprehensive Plan shall not constitute zoning regulations or establish zoning district
boundaries."
SECTION 4: It is hereby declared to be the intention of the Board of Aldermen
of the Town of Westlake, Texas, that sections, paragraphs, clauses and phrases of this
Ordinance are severable, and if any phrase, clause, sentence, paragraph, or section of this
Ordinance shall be declared unconstitutional or illegal by the valid judgment or decree of
any court of competent jurisdiction, such unconstitutionality or illegality shall not affect
any of the remaining phrases, clauses, sentences, paragraphs, or sections of this
Ordinance since the same would have been enacted by the Board of Alderman of the
Town of Westlake without the incorporation in this Ordinance of any such
unconstitutional or illegal phrase, clause, sentence, paragraph, or section.
SECTION 5: This Ordinance shall become effective upon its passage.

TOWN OF WESTLAKE, TEXAS, ON THIS 22" , DAY OF MARCH, 2004.
