ORDINANCE NO. 447
AN ORDINANCE ALTERING THE PRIMA FACIE SPEED LIMITS
ESTABLISHED FOR VEHICLES UNDER THE PROVISIONS OF SECTION
545.355 OF THE TEXAS TRANSPORTATION CODE UPON STATE HIGHWAY
NO. 114 OR PARTS THEREOF, WITHIN THE CORPORATE LIMITS OF THE
TOWN OF WESTLAKE, AS SET OUT IN THIS ORDINANCE; PROVIDING A
SEVERABILITY CLAUSE; AND PROVIDING A PENALTY OF A FINE NOT
TO EXCEED 5200.00 FOR THE VIOLATION OF THIS ORDINANCE.
WHEREAS, S ection 545.356 o f t he T exas T ransportation C ode p rovides t hat
whenever the Town of Westlake Board of Aldermen shall determine upon the basis of an
engineering and traffic investigation that any prima facie speed therein set forth is greater
or less than is reasonable or safe under the conditions found to exist at any intersection or
other place or upon any part of a street or highway within the Town, taking into
consideration the width and condition of the pavement and other circumstances on that
portion of the street or highway, as well as the usual traffic thereon, the governing body
may determine and declare a reasonable and safe prima facie speed limit thereat or
thereon by the passage of an ordinance, which shall be effective when appropriate signs
giving notice thereof are erected at the intersection or other place or part of the street or
highway; and
WHEREAS, at the request of the Texas Department of Transportation
("TxDOT"), the Town of Westlake adopted speed limits for portions of State Highway
No. 114 within the Town Limits of Westlake through the passage of Ordinance 352; and
WHEREAS, Ordinance 352 relied upon and incorporated therein by reference a
speed zone study completed by TxDOT dated January 31, 2000, which speed zone study
was in full compliance with the provisions of the Texas Transportation Code; and
WHEREAS, Ordinance 352 was passed in full compliance with the requirements
of the Texas Transportation Code; and
WHEREAS, since the passage of Ordinance 352, TxDOT has added additional
main lanes to State Highway No. 114 (hereinafter referred to as the "main lanes") for the
areas covered by Ordinance 352; and
WHEREAS, Ordinance 352 has been applicable to all portions of State Highway
No. 114 addressed by said ordinance, including the main lanes since its passage, and
since the opening of the main lanes; and
WHEREAS, in spite of the ongoing applicability and validity of Ordinance 352,
TxDOT removed some of the speed limit signs for the areas of State Highway No. 114
covered by Ordinance 352; and
WHEREAS, the a bsence o f s peed 1 imit signs o n S tate H ighway No. 1 14 ha s
created an urgent public necessity and an imminent threat caused by an unforeseeable
situation; and
WHEREAS, the Town is in receipt of two separate, qualified speed zone studies
for State Highway No. 114: one dated January 31, 2000, and one dated February 24,
2004, which speed zone studies are attached hereto and incorporated herein by reference;
and
WHEREAS, said speed zone studies support the passage of the speed limits
adopted herein; and
WHEREAS, the Town of Westlake Board of Aldermen deems the passage of this
ordinance as necessary to protect the public, health, safety, and welfare.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
ALDERMEN OF THE TOWN OF WESTLAKE, TEXAS:
SECTION 1: All matters stated in the preamble are found to be true and correct
and are incorporated herein by reference as if copied in their entirety.
SECTION 2: Upon the basis of an engineering and traffic investigation
heretofore made as authorized by the provisions of Section 545.356 of the Texas
Transportation Code, the following prima facie speed limits indicated for vehicles are
hereby determined and declared to be reasonable and safe; and these speed limits are
hereby fixed as the rate of speed for vehicles traveling upon the named streets and
highways, or part thereof, described as follows:
A. That from and after the date of the passage of this speed zone ordinance,
no motor vehicle shall be operated along and upon the main lanes of SH 114 within the
corporate limits of the Town of Westlake in excess of:
60 miles per hour, beginning at Mile Post 12.765; thence continuing along
SH 114 in an easterly direction for a distance of 0.925 miles, to Mile Post 13.690; and
• 60 miles per hour, beginning at Mile Post 13.690; thence continuing along
SH 114 in a westerly direction for a distance of 0.925 miles to Mile Post 12.765.
B. That from and after the date of the passage of this speed zone ordinance,
no motor vehicle shall be operated along and upon the portions of SH 114 which are not
the main lanes, within the corporate limits of the Town of Westlake in excess of:
• 55 miles per hour, beginning at Mile Post 13.300, being Denton/Tarrant
County line; thence continuing along SH 114 in a westerly direction for a distance of
2.105 miles, to Mile Post 11.195, being the Town of Westlake town limits.
• 50 miles per hour, beginning at Mile Post 11.195, being the Town of
Westlake town limits; t hence continuing along SH 114 in an easterly direction for a
distance of 2.105 miles to Mile Post 13.300, being Denton/Tarrant County line.
SECTION 3: The Town Manager, upon approval by the Board of Aldermen, is
hereby authorized to cause to be erected appropriate signs indicating this speed zone.
SECTION 4: Any person violating any of the provisions of this ordinance shall
be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in any
sum not to exceed Two Hundred Dollars ($200.00).
SECTION 5: If any section, article, paragraph, sentence, clause, phrase or word
in t his O rdinance, o r it s a pplication t o a ny p erson o r c ircumstance is he Id inv alid o r
unconstitutional by a Court of competent jurisdiction, such holding shall not affect the
validity of the remaining portions of this Ordinance; and the Town Board of Aldermen
hereby declares it would have passed such remaining portions of the Ordinance despite
such invalidity, which remaining portions shall remain in full force and effect.
