ORDINANCE NO. 445
AN ORDINANCE BY THE BOARD OF ALDERMEN OF THE TOWN OF
WESTLAKE, TEXAS CALLING AND ORDERING AN ELECTION TO BE HELD ON
THE 15th DAY OF MAY, 2004, THE THIRD SATURDAY IN THAT MONTH, FOR
THE PURPOSE OF ELECTING A MAYOR AND TWO ALDERMEN FOR THE TOWN
OF WESTLAKE, TEXAS, IN ACCORDANCE WITH THE PROVISIONS OF SECTION
23.023, TEXAS LOCAL GOVERNMENT CODE; ESTABLISHING THE HOURS AND
PLACE FOR THE ELECTION; PROVIDING FOR THE POSTING OF NOTICE OF
THE ELECTION; APPOINTING THE PRESIDING JUDGE; DIRECTING THE TOWN
SECRETARY TO MAKE UP THE OFFICIAL BALLOTS, CAUSE THEM TO BE
PRINTED AND DELIVERED TO THE PRESIDING OFFICER; PROVIDING FOR
THE CANVASSING OF THE RETURNS OF THE ELECTION; AND DECLARING AN
EFFECTIVE DATE.
THE BOARD OF ALDERMEN OF THE TOWN OF WESTLAKE, TEXAS HEREBY
ORDAINS:
SECTION 1: That an election shall be held at the Town Hall, 2650 J.T. Ottinger Road,
in the Town of Westlake, Texas, between the hours of 7:00 a.m. and 7:00 p.m. on the 15"
day of May, 2004, the third Saturday of that month, for the purpose of electing a Mayor and
two (2) Aldermen for two (2) year terms for the Town of Westlake, Texas, in accordance with
Section 23.023 of the Texas Local Government Code.
SECTION 2: That early voting by personal appearance shall be held at the Town
Hall, 2650 J.T. Ottinger Road, in the Town of Westlake, Texas between the hours of 9:00
a.m. and noon and again between 1:00 p.m. and 5:00 p.m. beginning on Wednesday, April
28, 2004, and ending on Tuesday, May 11, 2004.
SECTION 3: That the person receiving the highest number of votes for Mayor and two
(2) candidates for the Board of Aldermen who receive the highest number of votes shall be
elected for two (2) year terms.
SECTION 4: That notice of the election shall be given by posting true copies of the
Notice of General Election signed by the Mayor, in the Town Hall for at least twenty (20)
consecutive days prior to the date of the election.
SECTION 5: That Wanda Haskins is hereby appointed presiding judge of the election
and Tweedle Hamilton as the alternate judge. The presiding judge shall appoint such assistants
as may be necessary to properly conduct the election, as provided by the Election Code. That
the presiding judge will be compensated at the rate of $10.00 per hour and the alternate judge
and any assistant appointed by the presiding judge will be compensated at the rate of $8.00 per
hour.
SECTION b: That the Town Secretary shall make up the official ballot from the names
presented to her by application as provided by the Election Code, and she is hereby authorized
and directed to have the ballots to be used in the election printed and delivered to the presiding
judge.
SECTION 7: That immediately after the counting of the votes the presiding judge shall
deliver the official returns of the election to the Town Secretary.
SECTION 8: That on Monday, May 24`h, the Board of Aldermen shall canvass the
returns and declare the results which shall be recorded in the Minutes of the Board of
Aldermen.
SECTION 9: That the person who receives the most votes for Mayor and two (2)
candidates for Alderman who receive the highest number of votes shall be elected to two (2)
year terms, and the Mayor shall deliver a certificate of election to the successful candidates. If
two or more candidates tie with the same number of votes so that one or more of the tied
candidates would not be elected, the Board of Aldermen shall order a second election to be
held on the thirty fifth day after the first election at which only the names of the candidates
who receive the same number of votes at the first election shall be printed on the ballot. In the
event of a tie at the second election, the tied candidates shall cast lots to determine which one
shall be declared elected.
