RESOLUTION NO. 05-13
A RESOLUTION OF THE BOARD OF ALDERMAN OF THE TOWN OF
WESTLAKE, TEAS AMENDING THE 2004-2005 GENERAL FUND BUDGET
BY $31,250 IN ACCORDANCE WITH THE SETTLEMENT OF
WEYERHAEUSER DIB/A TRUS JOIST V. TOWN OF WESTLAKE, BETTER
BUILDERS, INC. AND MANHATTAN CONSTRUCTION COMPANY.
WHEREAS, the Town of Westlake has adopted the 2004-2005 General Fund
budget in August of 2005; and
WHEREAS, the Town Manager and Town Attorney have concluded their
participation in a mediation proceeding intended to resolve differences and avoid further
costly litigation between the Town and a material supplier on the Westlake Civic Campus
in February, and
WHEREAS, upon advice of counsel, the Board of Aldermen agrees with the
terms of the mediation in order to settle the lawsuit.
NOW THEREFORE BE IT RESOLVED BY THE BOARD OF ALDERMAN OF
THE TOWN OF WESTLAKE, TEXAS:
SECTION 1: THAT the Board of Aldermen of the Town of Westlake direct the
Town Manager to amend the 2004-2005 budget by reducing $31,250 from the General
Fund Balance and adding that amount to the General Fund, Account #43307-11,"Legal
Expenses", for the purposes of settling the aforementioned litigation.
PASSED AND APPROVED ON THE 14" DAY OF MARCH 2005.
