Home My WebLink AboutRes 05-03 Authorizing an Agreement with TxDot to Sell Surplus Right of Way on SH 377TOWN OF WESTLAKE RESOLUTION NO. 05-03 A RESOLUTION OF THE BOARD OF ALDERMEN OF THE TOWN OF WESTLAKE, TEXAS, AUTHORIZING THE TOWN MANAGER TO ENTER INTO AN AGREEMENT WITH THE TEXAS DEPARTMENT OF TRANSPORTATION TO SELL SURPLUS RIGHT OF WAY LOCATED ALONG SH 377 IN WESTLAKE. WHEREAS, The Texas Department of Transportation ("TxDOT") has asked to purchase surplus right of way from the Town of Westlake ("Town") to accommodate the SH 377 widening project; and WHEREAS, The Town agrees with the required appraisal completed by the Texas Department of Transportation which establishes a value of $23,500 for this property which is comprised of 0.100 of an acre of land as described in the legal description attached as Exhibit A, and WHEREAS, The Board of Aldermen of the Town has considered the cost and benefit of owning such property and determined that they will authorize the sale of the property. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN TO THE TOWN OF WESTLAKE, TEXAS: SECTION 1: The Town Manager is authorized to execute any and all documents necessary to effectuate the sale of said property to the Texas Department of Transportation. SECTION 2: The revenue will be credited to the Town of Westlake General Fund. PASSED AND APPROVED ON THIS 10TH DAY OF JANUARY 2005. ATTEST: Scott Brad ey, Mayor Trent O.
