RESOLUTION NO. 05-02
A RESOLUTION OF THE TOWN OF WESTLAKE BOARD OF ALDERMEN OF THE
TOWN OF WESTLAKE, TEXAS, AUTHORIZING AN EXTENSION OF THE
CHARTER CABLE FRANCHISE AGREEMENT UNTIL NOVEMBER 17, 2005;
PROVIDING A SAVINGS CLAUSE AND AN EFFECTIVE DATE.
WHEREAS, Marcus Cable Associates, LLC 1/k/a Charter Communications ("Charter")
currently holds an expired cable franchise with the Town of Westlake, Texas ("Town"), granted
by Ordinance No. 171 ("Franchise"), in September 12, 19$$; and
WHEREAS, Charter and the Town of Westlake, Texas have not completed informal
renewal negotiations in accordance with Section 626(h) of Title VI of the Communications Act
of 1934, as amended; and
WHEREAS, the parties continue to reserve all rights under the formal procedures of
Section 626 of Title VI of the Communication Act of 1934, as amended, and do not waive any
rights related thereto; and
WHEREAS, it is Charter's intention to extend its cable plant to the Vaquero and
Stagecoach Hills developments within the Town's jurisdictional boundaries in 2005;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE
TOWN OF WESTLAKE, TEXAS:
SECTION 1. That the Franchise of Charter shall be extended through November 17,
2005.
SECTION 2. If any provision of this Resolution shall be held invalid or
unconstitutional, then the remainder of such Resolution shall remain in full force and effect as if
separately enacted.
SECTION 3: That this Resolution shall be in force and take effect immediately upon its
passage.
