ORDINANCE NO. 481
AN ORDINANCE OF THE TOWN OF WESTLAKE, TEXAS ANNEXING
APPROXIMATELY 1.0 ACRE OF THE G. B. HENDRICKS SURVEY, ABSRACT 680,
TARRANT COUNTY, TEXAS, INTO THE TOWN LIMITS OF THE TOWN OF
WESTLAKE, TEXAS, PURSUANT TO SECTION 43.028 OF THE TEXAS LOCAL
GOVERNMENT CODE; PROVIDING FOR A SEVERABILITY CLAUSE; AND
PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, the property owners of approximately 1.0 acre of the G. B. Hendricks
Survey, Tarrant County, Texas, have petitioned the Town of Westlake to annex the property as
shown on attached Exhibit "A", (hereinafter the "Property"); and
WHEREAS, the property was previously annexed into the Town under Ordinance Nos.
237, 253, and 289; and the property owners nor any of their predecessors have ever petitioned for
disannexation; and
WHEREAS, the property owners wish to confirm and ratify the annexation of the
Property under those ordinances, and, in the alternative, have their Property annexed by this
ordinance: and
WHEREAS, the Property is one-half mile or less in width; and
WHEREAS, the Property is contiguous to the current Town Limits of the TOWN OF
WESTLAKE, Texas; and
WHEREAS, the Property is vacant and without residence or on which fewer than three
qualified voters reside; and
WHEREAS, the Board of Aldermen of the Town of Westlake previously considered the
petition and heard any and all arguments for or against the petition; and
WHEREAS, the Board of Aldermen of the Town of Westlake granted the petition for
annexation; and
WHEREAS, all of the provisions of Section 43.028 of the Texas Local Government
Code have hereby been met.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF
THE TOWN OF WESTLAKE, TEXAS:

SECTION 1. That all of the above findings are hereby found to be true and correct and
are incorporated into the body of this Ordinance in their entirety.
SECTION 2. The Property shown on attached Exhibit "A" shall hereby be annexed into
the Town Limits of the Town of Westlake, Texas, for full municipal purposes; and the
annexation of the Property under Ordinance Nos. 237, 253, and 289 is hereby confirmed and
ratified.
SECTION 3. The terms and provisions of this Ordinance shall be deemed to be
severable and that if the validity of any section, subsection, sentence, clause or phrase of this
Ordinance should be declared invalid or unconstitutional by the valid judgment or decree of any
court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity
of any other section, subsection, sentence, clause or phrase of this Ordinance.
SECTION 4. This Ordinance shall become effective from and after its date of passage.

WESTLAKE, TEXAS, ON THIS 27th day of JUNE 2005.

ANNEXATION PURSUANT TO SECTION 43.028 OF THE
TEXAS LOCAL GOVERNMENT CODE

TO THE MAYOR AND BOARD OF ALDERMEN OF THE TOWN OF WESTLAKE,
TEXAS, A TYPE A GENERAL LAW MUNICIPALITY IN AND FOR THE STATE OF
TEXAS:
I, the undersigned, JOE C. SKAGGS, having been duly sworn depose as follows:
1. "My name is JOE C. SKAGGS. I am over the age of eighteen, have never been
convicted of a felony, and am of sound mind, fully capable of making this affidavit and
personally acquainted with the facts herein stated:
2. I am the owner of a parcel of land known as 2125 North Pearson Lane, and
further described in the attached Exhibit A (hereinafter the "Property"). The Property is located
within the extraterritorial jurisdiction of the Town of Westlake, is contiguous to the Town Limits
of the Town of Westlake, is one-half mile or less in width, and is vacant and without residents or
on which fewer than three (3) qualified voters reside.
3. As the owner of the Property, I hereby petition the Board of Aldermen to extend
the present Town municipal boundaries so as to include the Property as part of the Town for all
purposes. By filing this Affidavit with the Mayor of the Town of Westlake, in care of the Town
Manager of the Town of Westlake, I certify my desire that the Property be annexed by the Town
of Westlake in accordance with Section 43.028 of the Texas Local Government Code. I further
certify, ratify and confirm that the Property has been continually located within the municipal
boundaries of the Town of Westlake from March 6, 1995, through the present."

in Volume 2271, Page 36, Deed Records, Tarrant County, Texas, being

BEGINNING at a point 475 verse West and 237.5 verse North of
the Southeast corner of said survey also being in the centerline of
Pearson Lanel
THENCE North along centerline of Pearson Lane, 139.1 feet to a
point for corners
THENCE East passing an iron pin at a distance of 23.0 feet
