AN ORDINANCE OF THE TOWN OF WESTLAKE, TEXAS ANNEXING A PORTION
OF THE R. BAKER SURVEY, TARRANT COUNTY, TEXAS, COMMONLY
REFERRED TO AS THE STAGECOACH HILLS SUBDIVISION, INTO THE TOWN
LIMITS OF THE TOWN OF WESTLAKE, TEXAS, PURSUANT TO SECTION 43.024
OF THE TEXAS LOCAL GOVERNMENT CODE; CONFIRMING AND RATIFYING
THE PRIOR ANNEXATIONS OF THE AREA UNDER ORDINANCES 237, 253, AND
289; PROVIDING FOR A SEVERABILITY CLAUSE; AND PROVIDING FOR AN
EFFECTIVE DATE
1WiIER + AS, the majori y' of the qualified voters of the area more specifically defined as
a portion of the R. Baker Survey, Tarrant County, Texas, have voted to request the Town of
Westlake to annex the property as shown on attached Exhibit "A", (hereinafter the "Area"); and
WHEREAS, three (3) qualified voters of the Area have prepared and executed an
affidavit to the fact of the vote and filed it with the Mayor of the Town of Westlake; and
WHEREAS, the Area was previously annexed into the Town under Ordinance Nos. 237,
253, and 289; and the property owners nor any of their predecessors have ever petitioned for
disamlexation; and
WHEREAS, the majority of the qualified voters of the Area wish to confirm and ratify
the annexation of the Area under those ordinances, and, in the alternative, have their Area
annexed by this ordinance; and
WHEREAS, the Area is one-half mile or less in width; and
WHEREAS, the Town of Westlake is a Type -A general law municipality; and
WHEREAS, the Area is contiguous to the current Town Limits of the Town of
Westlake, Texas; and

the filed Affidavit submitted to the Mayor, the Affidavit being attached hereto and incorporated
herein as Exhibit `B"; and
WHEREAS, all of the provisions of Section 43.024 of the Texas Local Government
Code have hereby been met.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE
TOWN OF WESTLAKE, TEXAS:
SECTION 1. That all of the above findings and exhibits are true and correct and are
incorporated into the body of this Ordinance in their entirety.

SECTION 2. The Area shown on attached Exhibit "A" is hereby annexed into the Town
Limits of the Town of Westlake, Texas, for full municipal purposes; and the annexation of the
Area under Ordinances Nos. 237, 253, and 289 is hereby confirmed and ratified.
SECTION 3. The terms and provisions of this Ordinance shall be deemed to be
severable and that if the validity of any section, subsection, sentence, clause or phrase of this
Ordinance should be declared invalid or unconstitutional by the valid judgment or decree of any
court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity
of any other section, subsection, sentence, clause or phrase of this Ordinance.
SECTION 4. This Ordinance shall become effective from and after its date of passage.

WESTLAKE, TEXAS, ON THIS 27th day of JUNE 2005.

AFFIDAVIT OF ELECTION

We, the undersigned, Billy D. Buckmeyer, Kenson R. Vance, and Eugene E. Morris
having been duly sworn depose as follows:
"Our names are Billy D. Buckmeyer, Kenson R. Vance, and Eugene E. Morris. Each of
us is over the age of eighteen, has never been convicted of a felony, and is of sound mind, fully
capable of making this affidavit and personally acquainted with the facts herein stated:
2. We are qualified voters of an area contiguous to the Town Limits of the Town of
Westlake, and as shown and described in the attached Exhibit "A" (hereinafter the "Area"). The
Area is located within the extraterritorial jurisdiction of the Town of Westlake, is contiguous to
the Town. Limits of the Town of Westlake, and is one-half mile or less in width.
We hereby certify that over the period of June 16, 2005 thru June 19, 2005, an election
was held among the qualified voters who own property and reside in the Area, and that in such
election a majority of said voters voted in favor of the Area being annexed into and becoming a
part of the Town of Westlake. Evidence of said election is also attached hereto as Exhibit "A".
By filing this Affidavit with the Mayor of the Town of Westlake, care of the Town of Westlake,
we certify that a majority of the qualified voters who own property and reside in the Area desire
that the Area be annexed by the Town of Westlake in accordance with Section 43.024 of the
Texas Local Government Code."

Stagecoach Hills, and more specifically described and depicted on attached Exhibit "A"
(hereinafter referred to as the "Area"), by affixing our signatures hereto, do hereby vote
to have the Area annexed into the Town of Westlake, Texas, pursuant to Section 43.024
of the Texas Local Government Code, or other applicable laws, for full municipal
purposes. Further, by affixing our signatures hereto, we, the majority of the qualified
voters of the Area, ratify and reaffirm all prior annexations and inclusions of the Area
into the Town of Westlake, Texas.
To evidence our vote to request annexation of the Area into the Town of
Westlake, Texas, we, the majority of the qualified voters of the Area, have affixed our

affidavit to the fact of this vote and file the affidavit with the Mayor of the Town of
