ORDINANCE NO. 510
AN ORDINANCE OF THE TOWN OF WESTLAKE, TEXAS, AMENDING THE
WESTLAKE CODE OF ORDINANCES, CHAPTER 90 TRAFFIC AND VEHICLES,
SECTION 90-52, ALLOWING FOR THE ADDITION OF YIELD SIGNS IN
WESTLAKE, TEXAS; PROVIDING A PENALTY CLAUSE; PROVIDING FOR A
SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Town of Westlake desires to maintain a safe environment for motorists
and pedestrians utilizing Westlake streets and thoroughfares; and
WHEREAS, the Board of Aldermen have adopted Section 90-52 of the Code of
Ordinances to itemize all approved stop signs used on town owned and maintained streets; and
WHEREAS, the traveling public will better served by an amendment to the Town of
Westlake Code of Ordinances, Chapter 90 TRAFFIC AND VEHICLES, Section 90-52,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE
TOWN OF WESTLAKE, TEXAS:
SECTION 1: All matters stated in the preamble are found to be true and correct and are
incorporated herein as if copied in their entirety.
SECTION 2: Chapter 90 TRAFFIC AND VEHICLES, Section 90-52 is hereby amended
to read as follows:
Sec. 90-52. Traffic Signs Ste}signs.
Additionally, this amendment will add sections (c) and (d) to existing sections (a) and (b) to read
as follows:
(c) Yield signs, as warranted by an engineering and traffic investigation, shall be erected
as determined by the town traffic engineer or transportation planner under the direction of
the town manager.
(d) Every driver of a vehicle approaching a yield intersection shall yield before entering
the crosswalk on the near side of the intersection or, in the event there is no crosswalk,
shall yield at a clearly marked stop line, but if none, then at the point nearest the
intersecting roadway where the driver has a view of approaching traffic on the
intersecting roadway, except when directed to proceed by a police officer or traffic control
signal. The yield intersections and locations of yield signs are as follows:
(1) At the southwest corner intersection of Stagecoach Circle and Thornton Drive facing
west on Stagecoach Circle, indicating eastbound drivers to yield to all Thornton Drive
traffic.
(2) At the southwest corner intersection of Janet Court and Thornton Drive facing west
on Janet Court, indicating eastbound drivers to yield to all Thornton Drive traffic.
SECTION 3: Any person violating any of the provisions of this ordinance shall be
deemed guilty of a misdemeanor offense and upon conviction thereof shall be fined in a sum not
to exceed the maximum established by State law for each separate offense. A separate offense
shall be deemed committed upon each day, or part of a day, during which a violation occurs or
continues.
SECTION 4: It is hereby declared to be the intention of the Board of Aldermen of the
Town of Westlake, Texas, that sections, paragraphs, clauses and phrases of this Ordinance are
severable, and if any phrase, clause, sentence, paragraph or section of this Ordinance shall be
declared legally invalid or unconstitutional by the valid judgment or decree of any court of
competent jurisdiction, such legal invalidity or unconstitutionality shall not affect any of the
remaining phrases, clauses, sentences, paragraphs or sections of this Ordinance since the same
would have been enacted by the Board of Aldermen of the Town of Westlake without the
incorporation in this Ordinance of any such legally invalid or unconstitutional, phrase, sentence,
paragraph or section.
