ORDINANCE NO. 498
AN ORDINANCE BY THE BOARD OF ALDERMEN OF THE TOWN OF WESTLAKE,
TEXAS CALLING AND ORDERING AN ELECTION TO BE HELD ON THE 13TH DAY
OF MAY, 2006, THE SECOND SATURDAY OF THE MONTH, FOR THE PURPOSE OF
ELECTING A MAYOR AND TWO ALDERMEN, IN ACCORDANCE WITH THE
PROVISIONS OF SECTION 23.023, TEXAS LOCAL GOVERNMENT CODE; AND FOR
THE PURPOSE OF DISSOLVING THE WESTLAKE 4A CORPORATION AND
ABOLITION OF THE ONE-HALF PERCENT SALES AND USE TAX FOR THE
PROMOTION AND DEVELOPMENT OF NEW AND EXPANDED BUSINESS
ENTERPRISES, AND THE ADOPTION OF AN ADDITIONAL SALES AND USE TAX
WITHIN THE TOWN AT THE RATE OF ONE-HALF OF ONE PERCENT TO BE USED
TO REDUCE THE PROPERTY TAX RATE; ESTABLISHING THE HOURS AND PLACE
FOR THE ELECTION; PROVIDING FOR THE POSTING OF NOTICE OF THE
ELECTION; PROVIDING FOR THE CANVASSING OF THE RETURNS OF THE
ELECTION; AND DECLARING AN EFFECTIVE DATE.
NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE
TOWN OF WESTLAKE, TEXAS:
SECTION 1: That an election shall be held at the Town Hall, 2650 J.T. Ottinger Road, in the
Town of Westlake, Texas, between the hours of 7:00 a.m. and 7:00 p.m. on the 13th day of May,
2006, the second Saturday of the month, for the purpose of electing a Mayor and two (2) Aldermen
for two (2) year terms, in accordance with Section 23.023 of the Texas Local Government Code.
SECTION 2: That one proposition on the ballot shall be for the purpose of dissolving the
Westlake 4A Corporation and abolition of the one-half percent sales and use tax for the promotion
and development of new and expanded business enterprises, and the adoption of an additional sales
and use tax within the Town at the rate of one-half of one percent to be used to reduce the property
tax rate. The ballot proposition shall allow voters to vote FOR or AGAINST the following:
"Dissolution of the Westlake 4A Corporation and abolition of the one-half of one
percent sales and use tax for the promotion and development of new and
expanded business enterprises, and the adoption of an additional sales and use tax
within the Town at the rate of one-half of one percent to be used to reduce the
property tax rate."
SECTION 3: That voting shall be conducted between the hours of 7:00 a.m. and 7:00 p.m.
on Saturday, May 13, 2006, at the Westlake Town Hall, 2650 J. T. Ottinger Road, Westlake, Texas,
76262.
SECTION 4: That early voting by personal appearance shall be held at the Town Hall, 2650
J.T. Ottinger Road, in the Town of Westlake, Texas between the hours of 8:00 a.m. 5:00 p.m.
beginning on Monday, May 1, 2006 and ending on Wednesday, May 3, 2006 and at other early
voting locations established by Tarrant County, pursuant to the Joint Election Agreement with the
County, beginning on May 1, 2006 and ending on the 9tb day of May, 2006 between the hours listed
below:

7:00 a.m. — 7:00 p.m.

SECTION 5: That Gayle Hamilton, Tarrant County Interim Elections Administrator, 2700
Premier Street, Fort Worth, Texas 76111, is hereby appointed as Early Voting Clerk and Jean
Dwinnell, Town Secretary, 2650 J. T. Ottinger Road, Westlake, Texas, 76262, shall serve as Deputy
Early Voting Clerk. Applications for ballot by mail must be received by the Early Voting Clerk by
mail no later than 5:00 p.m. on the 5"' day of May, 2006.

SECTION 6: That qualified persons may file as candidates by filing an application in the
office of the Town Secretary from 8:00 a.m. until 5:00 pan. beginning on Monday, February 13,
2006 (First business day to receive an application for a place on the ballot — 91" day before election
city offices are closed) through Monday, March 13, 2006.
SECTION 7: That Tarrant County's voting equipment will be utilized for said election (Hart
InterCivic eScan, optical scan voting system, and eSlate, direct recording electronic voting system
for both early voting by personal appearance and election day), and shall be conducted in accordance
with the Texas Election Code.
SECTION 8: That notice of the election shall be given by posting true copies of the Notice of
General Election signed by the Mayor, in the Town Hall for at least twenty (20) consecutive days
prior to the date of the election.
SECTION 9: That on Monday, May 22nd, the Board of Aldermen shall canvass the returns
and declare the results which shall be recorded in the Minutes of the Board of Aldermen.
SECTION 10: That the person who receives the most votes for Mayor and two (2)
candidates for Alderman who receive the highest number of votes shall be elected to two (2) year
terns, and the Mayor shall deliver a certificate of election to the successful candidates. If two or
more candidates tie with the same number of votes so that one or more of the tied candidates would
not be elected, the Board of Aldermen shall order a second election to be held on the thirty fifth day
after the first election at which only the names of the candidates who receive the same number of
votes at the first election shall be printed on the ballot. In the event of a tie at the second election,
the tied candidates shall cast lots to determine which one shall be declared elected.
SECTION 11: That this Ordinance shall become effective immediately upon passage.
