AN ORDINANCE AUTHORIZING THE BOARD OF ALDERMEN OF THE TOWN OF
WESTLAKE, TEXAS, ACTING FOR AND ON BEHALF OF THE TOWN, TO ENTER
INTO ALL NECESSARY AGREEMENTS WITH THE EMPLOYEES RETIREMENT
SYSTEM OF TEXAS TO EXTEND FEDERAL OLD -AGE, SURVIVORS, DISABILITY
AND HEALTH INSURANCE BENEFITS (SOCIAL SECURITY COVERAGE) TO THE
OFFICERS AND EMPLOYEES OF THE TOWN OF WESTLAKE, TEXAS, UNDER
PROVISIONS OF 42 UNITED STATES CODE 418, TITLE 6, CHAPTER 606, TEXAS
GOVERNMENT CODE AND OTHER APPLICABLE STATE AND FEDERAL LAWS;
AUTHORIZING THE TOWN MANAGER TO EXECUTE ALL NECESSARY
AGREEMENTS AND INSTRUMENTS FOR AND ON BEHALF OF THE TOWN;
DIRECTING THE HUMAN RESOURCES MANAGER TO MAKE ASSESSMENTS,
COLLECTIONS, AND REPORTS; AND ORDERING THE ALLOCATION OF
SUFFICIENT MONEY FROM AVAILABLE FUNDS TO CARRY OUT THE
PROVISIONS OF THE LAWS
WHEREAS, under the provisions of Title 6, Chapter 606, Texas Government Code, as
amended; and 42 United States Code 418, as amended, incorporated cities of this State may enter
into Agreements with the Employees Retirement System of Texas and secure the benefits of
Federal Old -lige, Survivors, Disability and Health Insurance (Social Security Coverage), as
outlined in said laws; and
WHEREAS, it is the desire of the Board of Aldermen to authorize the making of any and
all necessary Agreements in order to secure the benefits of said acts; therefore,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE
TOWN OF WESTLAKE, TEXAS, THAT:
SECTION 1: The Board of Aldermen, acting for and on behalf of the Town of Westlake,
Texas shall enter into all necessary Agreements with the Employees Retirement System of Texas
for the purpose of carrying out the provisions of the above-mentioned acts.
SECTION 2: The Town Manager is hereby appointed as Agent of the Board of
Aldermen and of the Town to execute all necessary Agreements and instruments for and in
behalf of the Town of Westlake.
SECTION 3. The Human Resources Manager is hereby directed to be the person
responsible for making assessments, collections, payments, and reports, as required by the
Employees Retirement System of Texas and as approved by the Town Manager.
SECTION 4. A sufficient sum of money be allocated from available funds for the
purpose of carrying out the provisions of the above-mentioned acts.

AGREEMENT
It is agreed by the EMPLOYEES RF-TIREMENT SYSTEM OF TEXAS and the
ENTITY NAS
a political subdivision of the STATE OF TEXAS, hereinafter referred to as the Entity, to extend Social Security
coverage under provisions of the Federal Social Secufity Act to the Entity's eligible employees.
Whereas, the ENTITY NAME, an Entity of the State, -filed wage reports and contribution returns trader the
Federal Insurance Contributions Act beginning with the period ending with DATE under Employers Identification
Number XXX XXX in the belief that such action would result in extending coverage under the provisions of the
Social Security Act, as amended; and
Whereas, in furtherance of this belief the said Entity continued to file wage reports and make contribution
payments under the Federal. Insurance Contributions Act'for each succeeding period after the period ending with
HATE; and
Whereas, the Ming of such wage reports and contribution returns under the Federal Insurance Contributions Act
was erroneous; and
Whereas, the Entity has established that services of its employees may be covered under the provisions of Section
218 of the Social Security Act, as amended; and
Whereas, the Entity has followed the incorrect procedure in effectuating such coverage; and
Whereas, the State of Texas and the Entity desire to correct the above error in said agreement.
Both parties agree to carry out their respective responsibilities under the provisions of the Federal Social Security
Act and the Federal Regulations published pursuant to that Act, Title 6, Chapter 606, Texas Government Code, and
the rules promulgated by the Trustees of the Employees Retirement System of Texas pursuant to that Act, and
other legal obligations that may app1Y•
The Entity agrees that the officer designated by its governing body will be responsible to assess,, collect and remit
both the employer and the employee contributions in amounts and at rates prescribed by law, on forms, and at
times required by the rules of the Federal Social Security Act, the internal revenue Service, and the Employees
Retirement Systema of Texas_
The Entity agrees to cover all employees of the Entity except those performing services specifically excluded by
law and those performing the services listed below:
LIST. EXCLUSIONS
The Entity agrees to appropriate on or before DATE each year the amount of priority dedicated revenues sufficient
to meet its obligations under the terms of this agreement.
The effective date of this agreement is DATE.
