HomeMy WebLinkAboutOrd 496 Renaming Kirkwood Boulevard to Solana BoulevardTOWN OF WESTLAKE ORDINANCE NO. 496 AN ORDINANCE OF THE TOWN OF WESTLAKE, TEXAS, AMENDING THE WESTLAKE CODE OF ORDINANCES, RENAMING KIRKWOOD BOULEVARD TO SOLANA BOULEVARD WITHIN THE CORPORATE LIMITS OF THE TOWN OF WESTLAKE, TEXAS; PROVIDING A CUMULATIVE CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the Board of Aldermen of the Town of Westlake, Texas, is of the opinion that it is in the best interests of the town and its citizens that the amendment to the Code of Ordinances for the Town of Westlake should be approved and adopted; and WHEREAS, upon passage of this ordinance, the effective date of the renaming will be the day TXDoT erected signage on January 23, 2006, designating Kirkwood Boulevard in the corporate limits of the Town of Westlake as Solana Boulevard; and WHEREAS, by the passage of this ordinance and the posting of signage, shall in effect serve notice of the change to the general public and for the businesses located on Solana Boulevard, by notification to the proper authorities, owners, and tenants; and NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE TOWN OF WESTLAKE, TEXAS: SECTION 1: That, the above findings are hereby found to be true and correct and are incorporated herein in their entirety. SECTION 2: That, the Westlake Code of Ordinances and all Westlake plans and maps are to be hereby amended as it pertains to the renaming of Kirkwood Boulevard, now and henceforth to be known as Solana Boulevard in the corporate limits of the Town of Westlake, with all other provisions of the ordinance remaining in effect. SECTION 3: This ordinance shall be cumulative of all provisions of ordinances of the Town of Westlake, Texas, except where provisions of this ordinance are in direct conflict with the provisions of another ordinance, in which event the conflicting provisions of the other ordinance are hereby repealed. SECTION 4: It is hereby declared to be the intention of the Board of Aldermen of the Town of Westlake, Texas, that sections, paragraphs, clauses and phrases of this Ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this Ordinance shall be declared legally invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such legal invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs or sections of this Ordinance since the same would have been enacted by the Board of Aldermen of the Town of Westlake without the incorporation in this Ordinance of any such legally invalid or unconstitutional, phrase, sentence, paragraph or section. SECTION 5: All rights and remedies of the Town of 'Westlake are expressly saved as to any and all violations of the provisions of the Code of Ordinances, Town of Westlake, Texas, as amended, or any other ordinances affecting such code which have accrued at the time of the effective date of this ordinance; and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such ordinances, same shall not be affected by this ordinance but may be prosecuted until final disposition by the courts. SECTION 6: This Ordinance shall take effect from and after its date of passage in accordance with law, and it is so ordained. PASSED AND APPROVED this 13th day of FEBRUARY, 2006.
