HomeMy WebLinkAboutOrd 528 Calling the November 6, 2007 a Bond Election for 2.5MTOWN OF WESTLAKE ORDINANCE NO. 528 ORDINANCE CALLING A BOND ELECTION; PROVIDING FOR THE CONDUCT AND THE GIVING OF NOTICE OF THE ELECTION; AND ENACTING OTHER PROVISIONS RELATING TO THE SUBJECT WHEREAS, this Board of Aldermen finds and determines that it is necessary and advisable to call and hold an election within the Town of Westlake, Texas, on the proposition hereinafter set forth; Now, Therefore BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE TOWN OF WESTLAKE: Section 1. Election Ordered; Proposition. An election shall be held in the Town of Westlake, Texas, on November C, 2007, between the hours of 7:00 a.m. and 7:00 p.m., at which election the following proposition shall be submitted in accordance with law: PROPOSITION Shall the Board of Aldermen of the Town of Westlake, Texas, be authorized to issue the bonds of said Town, in one or more series or issues, in the aggregate principal amount of $2,500,000, with the bonds of each such series or issue, respectively, to mature serially or otherwise within not to exceed 40 years from their date, and to be sold at such prices and bear interest at such rates as shall be determined within the discretion of the Board of Aldermen, in accordance with law at the time of issuance, for the purpose of constructing and equipping a building and related improvements to be used for a civic center and for science classrooms and laboratories for the Westlake Academy, and shall said Board of Aldermen be authorized to levy and cause to be assessed and collected annual ad valorem taxes in an amount sufficient to pay the annual interest on said bonds and provide a sinking fund to pay said bonds at maturity? Section 2. Precincts and Polling Places. The election precincts for said election only, and the polling place for each such precinct on election day, are set forth in Exhibit A attached hereto, which is incorporated herein by reference and made a part hereof for all purposes. Section 3. Early Voting. The Main Early Voting Polling Place, the Branch Early Voting Polling Places for conducting early voting by personal appearance, the dates and hours for early voting by personal appearance and the address for early voting by mail for said election are hereby designated as set forth in Exhibit A attached hereto. Section 4. Election Officers. The election officers designated by the Tarrant County Elections Administrator are hereby appointed and confirmed to hold said election at said polling places. As determined by the Tarrant County Elections Administrator, the Presiding Judges shall appoint not less than two nor more than five qualified election clerks to serve and assist in conducting said election; providing that if the Presiding Judge actually serves as expected, the Alternate Presiding Judge shall be one of such clerks. An early ballot board is hereby created to process early voting results, and the individual designated by the Tarrant County Elections Administrator is hereby appointed the presiding judge of said board. The presiding judge shall appoint at least two other members of the board. Steve Raborn, Tarrant County Elections Administrator, shall serve as early voting clerk for the election. Section 5. Ballots. The official ballots for said election shall be prepared in accordance with the Texas Election Code so as to permit the electors to vote "FOR" or "AGAINST" the aforesaid PROPOSITION, with the ballots to contain such provisions, markings and language as required by law, and with such PROPOSITION to be expressed substantially as follows: PROPOSITION FOR THE ISSUANCE OF $2,500,000 TAX BONDS FOR CONSTRUCTING AND EQUIPPING A BUILDING AND RELATED IMPROVEMENTS TO BE USED FOR A CIVIC CENTER AND FOR SCIENCE CLASSROOMS AND LABORATORIES FOR THE WESTLAKE ACADEMY AGAINST Section 6. Conduct of Election. (a) All resident qualified electors of said Town shall be permitted to vote in said election. (b) The election materials enumerated in Secs. 272.001, et seq., V.T.C.A. Election Code, shall be printed and ftm- i shed in both English and Spanish for use at the polling place on election day and for early voting. (c) In all respects said election shall be conducted in accordance with the Texas Election Code. Pursuant to the federal Help America Vote Act and the Texas Election Code, each polling place shall be provided at least one voting system equipped for individuals with disabilities. Sufficient voting equipment to accommodate the voters shall be provided for early voting and at each of the polling places on election day. Section 7. Notice of Election; Notice of Early Voting Schedule. (a) Notice of said election shall be given by.posting substantial copies of this Ordinance in both English and Spanish on the bulletin board in the Town Hall of said Town used for posting notices of meetings of the Board of Aldermen of said Town, and at three (3) other public places in said Town not later than the 21 st day before election day; and substantial copies of this Ordinance in both English and Spanish shall be published on the same day in each of two (2) successive weeks in a newspaper of general circulation in said Town, the date of the first publication to be not more than thirty (3 0) or less than fourteen (14) days prior to the date set for said election. (b) Such notice, as posted and published, shall include and constitute a schedule stating (i) the location of each temporary branch early voting polling place for said election, the election precincts served by each branch polling place and the dates and hours that temporary branch voting will be conducted and (ii) the locations, dates and hours for any extended time for early voting by personal appearance. Section 8. Separate Election. Said election shall be conducted as a Separate election, including early voting, with Collin County pursuant to the Separate Election Agreement and Contract for Election Services, to be administered by the Tarrant County Elections Administrator pursuant to the Separate Election Agreement and Contract for Election Services. Section 9. Effective Date. 1n accordance with the provisions of V.T.C.A., Government Code, Section 1201.028, this Ordinance shall be effective immediately upon its adoption by the Board of Aldermen.
