ORDINANCE NO. 525
AN ORDINANCE CANVASSING THE RETURNS AND DECLARING THE RESULTS OF
THE GENERAL ELECTION HELD ON MAY 12, 2007, FOR THE ELECTION OF THREE
(3) ALDERMEN, AND THE SPECIAL ELECTIONS HELD ON MAY 12, 2007, FOR THE
ELECTION OF TWO (2) ALDERMEN TO UNEXPIRED TERMS; ORDERING A SECOND
ELECTION TO BE HELD JUNE 16, 2007, TO ELECT AN ALDERMAN TO A TERM
EXPIRING MAY 2009; PROVIDING FOR NOTICE OF SAID ELECTION; PROVIDING
FOR EARLY VOTING; AND PROVIDING FOR A SEVERABILITY CLAUSE.
WHEREAS, the general election of 2007 was duly called and held in the Town of Westlake,
Texas on the 12TH day of May 2007, for the purpose of electing three (3) Aldermen to serve terms of
two -years; and
WHEREAS, special elections were duly called and held in the Town of Westlake, Texas on
the 12th day of May 2007, for the purpose of electing two (2) Aldermen to serve un -expired terms;
and
WHEREAS, it is hereby found and determined that notice of the elections were duly given in
the form, manner and time required by law, and said elections were in all respects legally held and
conducted in accordance with applicable laws of the State of Texas and the proceedings governing
the holding of such elections; and
WHEREAS, such canvass shows the following results:

THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE TOWN OF
WESTLAKE, TEXAS:
SECTION 1: RECITALS FOUND TRUE.. All of the recitals contained in the preamble of
this ordinance are found to be true and are adopted as findings of fact and a part of this Board of
Aldermen's judgment.
SECTION 2: ELECTION CANVASSED AND DECLARED EFFECTIVE. It is further
found and determined that the results of the election are as canvassed and tabulated in the preamble
hereof and in Exhibit "A" attached hereto. The Board further finds the following.
GENERAL ELECTION
April Gallagher has been elected as Alderwoman to a term expiring May 2009
Don Redding has been elected as Alderman to a term expiring May 2009
SPECIAL ELECTIONS
Bob Timmerman has been elected as Alderman to a term expiring May 2008
Peter Steger has been elected as Alderman to a term expiring May 2008
SECTION 3: TIE VOTE: the official election returns, indicate a two-way tie for the
office of Alderman to an expiring term of May 2009.
SECTION 4: SECOND ELECTION. That a second election is hereby ordered to be
held on the 16`x' day of June 2007, for the purpose of electing an Alderman to an expiring term of
May 2009; and
SECTION 5: CANDIDATES FOR SECOND ELECTION. That only the two
candidates receiving the tied vote shall be candidates in said second election, which candidates
are as follows:

Rick Rennhack
SECTION 6: POLLING PLACE. The polling place for the Election shall be as follows:
Westlake Town Offices
3 Village Circle
Westlake, Texas
The polls shall be open from 7:00 a.m. to 7:00 p.m. on June 16, 2007, in accordance with and
pursuant to the requirements of the Texas Election Code (the "Code").
SECTION 7: COMBINED BALLOTS. Combined ballots may be utilized containing all of
the offices and propositions to be voted on at each polling place, provided that no voter shall be
given a ballot or permitted to vote for any office or proposition on which the voter is ineligible to
vote. The County's voting equipment will be utilized for this election.
SECTION 8: EARLY VOTING.. Early Voting by personal appearance shall be conducted
at the County's Main Early Voting location;

and branch offices for early voting by personal appearance shall be established as outlined in the
election agreement with Tarrant County. Steve Rayborn, Tarrant County Elections Administrator, is
hereby appointed as the Early Voting Clerk and can appoint the necessary deputy clerks as required
for early voting. In accordance with Section 85.001 of the Texas Election Code, early voting by
personal appearance shall be as set forth below:
June 4 through June 8 (Monday — Friday) 8:00 a.m. to 5:00 p.m.
June 9 (Saturday) 8:00 a.m. to 5:00 p.m.
June 11 through June 12 (Monday — Tuesday) 7:00 am. to 7:00 p.m.
For the purpose of processing ballots cast in early voting, the election officers for the early voting
ballot board shall be appointed and designated in accordance with the provisions of the election
agreement with the Tarrant County Elections Administrator.
Application for ballot by mail may be sent beginning April 13, 2007, but received no later
than June 8, 2007, and mailed to:

SECTION 9: NOTICE. Notice of said elections shall be given as required by the Texas
Election Code.
SECTION 10: ELECTION OFFICIALS. The election judge, alternate election judge, and
ballot board will be appointed by the Tarrant County Elections Administrator, as permitted by law.
The presiding judge shall appoint elections clerks as may be necessary for the proper conduct of the
election. The election judge, or the alternate clection judge in the absence of the election judge, and
the election clerks shall constitute the early voting ballot board.
SECTION 11: ELECTION RESULTS. That the one (1) candidate for Alderman who
receives the highest number of votes shall be elected to a two (2) year term;
The Mayor shall deliver a certificate of election to the successful candidates. In the event of
a tie at the second election, the tied candidates shall cast lots to determine which one shall be
declared elected; and
SECTION 12: GOVERNING LAW. The election shall be held in accordance with the
Constitution of the State of Texas and the Texas Election Code, and all resident qualified voters of
the Town shall be eligible to vote at the election.
The Town shall constitute a single election precinct for said election.
SECTION 13: SEVERABILITY CLAUSE. It is hereby declared to be the intention of the
Board of Aldermen that the sections, paragraphs, sentences, clauses and phrases of this order are
severable and if any phrase, clause, sentence, paragraph, or section shall be declared invalid or
unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences,
paragraphs and sections of this order, since the same would have been enacted by the Board of
Aldermen without the incorporation in this order of any such invalid or unconstitutional phrase,
clause, sentence, paragraph or section.
SECTION 14: TOWN SECRETARY TO RECORD ELECTION RESULTS. The Town
Secretary is hereby authorized and directed to make the appropriate entries of information appearing
in the tabulation of precinct results shown in Exhibit "A" attached hereto in the election register
maintained by the Town in accordance with provisions of Section 67.006 of the Election Code.
SECTION 15: CITY STAFF TO TAKE NECESSARY ACTIONS TO GIVE EFFECT.
The Town Manager, Town Secretary, and Town Attorney are hereby authorized and instructed to
take all actions necessary to give effect to this ordinance and the election, as provided by law.
SECTION 16: EFFECTIVE DATE. This ordinance shall be effective upon its adoption.
