HomeMy WebLinkAboutOrd 605 Changing the name of the Board of Alderman to Town CouncilTOWN OF WESTLAKE ORDINANCE NO. 605 AN ORDINANCE OF THE TOWN OF WESTLAKE, TEXAS, CHANGING THE NAME OF THE BOARD OF ALDERMEN TO THE TOWN COUNCIL; PROVIDING AN EFFECTIVE DATE; AND PROVIDING FOR A SAVINGS CLAUSE. WHEREAS, the Town of Westlake is a Type A general law municipality; WHEREAS, the Texas Lo cal Government Code provides that the governing body of a Type A general law municipality consists of a mayor and five aldermen, when the Type A municipality is not divided into wards. WHEREAS, most people use the term "City Council" or "Town Council" when describing the governing body of a municipality. WHEREAS, there are no restrictions on what a governing body may name itself in the Texas Local Government Code or any other state laws; WHEREAS, the governing body of the Town of Westlake prefers to refer to itself as a Town Council, as that is a more familiar and comfortable term to its residence. WHEREAS, the governing body fully intends to abide by all of the requirements of the state law in regard to the governing body of a Type A municipality; WHEREAS, it is not the intent of the governing body of the Town of Westlake that the change in name from `Board of Aldermen" to "Town Council" would, in any way, change any of the duties or requirements of the governing body; WHEREAS, all references to ordinances, resolutions, orders or other matters previously before the Board of Aldermen remain valid and are not intended to be affected by the change in name from "Board of Aldermen" to "Town Council"; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE TOWN OF WESTLAKE, TEXAS: Section 1. That all matters stated in the preamble are found to be true and correct and are incorporated herein as if copied in their entirety. Section 2. That the Town hereby adopts Section 2-2 of the Code of Ordinances for the Town of Westlake, Texas, to read as follows: Section 2-2 Change in name of governing body. (a) The Town of Westlake hereby changes the name of its Board of Aldermen to Town Council (b) All references to Town Council or Board of Aldermen shall be understood to mean the governing body of the Town of Westlake. (c) The change in name from Board of Aldermen to Town Council does not affect any previously -passed ordinance, resolution, order, proclamation or other act of the governing body of the Town of Westlake. (d) The governing body will still have all the rights and responsibilities of a Type A general law municipality under state law and the change of name for its governing body from Board of Aldermen to Town Council does not affect any of said rights or responsibilities. Section 3. It is hereby declared to be the intention of the Board of Aldermen of the Town of Westlake, Texas, that sections, paragraphs, clauses and phrases of this Ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this Ordinance shall be declared legally invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such legal invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs or sections of this Ordinance since the same would have been enacted by the Board of Aldermen of the Town of Westlake without the incorporation in this Ordinance of any such legally invalid or unconstitutional, phrase, sentence, paragraph or section. Section 4. That this Ordinance shall take effect on the date of passage and publication as required by law. PASSED AND APPROVED this 10 day of NOVEMBER 2008.
