ORDINANCE NO. 602
AN ORDINANCE OF THE TOWN OF WESTLAKE, TEXAS; AMENDING
CHAPTER 18 OF THE TOWN OF WESTLAKE CODE OF ORDINANCES.
ADOPTING THE 2006 EDITIONS OF THE INTERNATIONAL RESIDENTIAL
CODE, INTERNATIONAL BUILDING CODE, INTERNATIONAL PLUMBING
CODE, INTERNATIONAL FUEL GAS CODE, INTERNATIONAL
MECHANICAL CODE AND THE INTERNATIONAL ENERGY
CONSERVATION CODE ALONG AND THE 2008 EDITION OF THE
NATIONAL ELECTRICAL CODE, WITH AMENDMENTS TO SAID CODES;
PROVIDING A PENALTY CLAUSE; PROVIDING A CUMULATIVE CLAUSE;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE;
AUTHORIZING PUBLICATION; AND ESTABLISHING AN EFFECTIVE
DATE.
WHEREAS, the Town of Westlake, Texas is a general law Town acting under
its charter adopted by the electorate pursuant to the Texas Constitution, and the Local
Government Code; and
WHEREAS, the Board of Aldermen of the Town of Westlake, Texas, finds it to
be in the best interest of the citizens, businesses and property owners in the Town of
Westlake, to adopt the 2006 editions of the International Residential, Building, Plumbing,
Fuel Gas, Mechanical and Energy Conservation Codes, and the 2008 edition of the
National Electrical Code, to provide for the safety of the citizens and visitors of
Westlake; and
WHEREAS, upon the recommendation of the Westlake Director of Planning and
Development, the Board of Aldermen of the Town of Westlake, Texas, is of the opinion
that it is in the best interests of the town and its citizens that certain amendments to the
International Codes that address concerns unique to the development within the Town of
Westlake, be approved and adopted along with the adoption of the proposed codes; and
WHEREAS, the Board of Aldermen of the Town of Westlake, Texas, deems it
necessary to amend certain sections of the Code of Ordinances relative to the
administration of these codes and the collection of fees for permitting, plan review, and
inspection services.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF
THE TOWN OF WESTLAKE, TEXAS:
SECTION l: That, the above findings are hereby found to be true and correct
and are incorporated herein in their entirety.
SECTION 2: That the following sections of Chapter 18 of the Code of
Ordinances, are hereby amended, to read as follows:

ARTICLE 1. IN GENERAL
ARTICLE II. CODES
Sec. 18-31. Adoption.
The town adopts in their entirety the 2006 Edition of the International Residential Code,
the 2006 Edition of the International Building Code, the 2006 Edition of the International
Energy Conservation Code, the 2006 Edition of the International Fuel Gas Code, the
2006 Edition of the International Mechanical Code, the 2006 Edition of the International
Plumbing Code and the 2008 Edition of the National Electrical Code, including the
amendments to such codes as attached to this ordinance. Amendments to these codes,
attached as Exhibit A and are to be kept on file and available in the office of the town
secretary.

SECTION 3: The material contained in Exhibit "A" to this ordinance shall not
be included in the formal municipal codification of ordinances, but shall be maintained as
a public record in the office of the Town Secretary and will be available for public
inspection and copying during regular business hours.
SECTION 4: PENALTY. Any person, firm, or corporation who violates,
disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any
of the provisions of this ordinance shall be fined not more than Two Thousand Dollars
($2,000.00) for all violations involving zoning, fire safety or public health and sanitation,
including dumping or refuse, and shall be fined not more than five hundred dollars ($500)
for all other violations of this ordinance. Each day that a violation is permitted to exist
shall constitute a separate offense.
SECTION 5: CUMULATIVE CLAUSE. This ordinance shall be cumulative
of all provisions of ordinances of the Town of Westlake, Texas, except where provisions
of this ordinance are in direct conflict with the provisions of another ordinance, in which
event the conflicting provisions of the other ordinance are hereby repealed.
SECTION 6: SEVERABILITY CLAUSE. It is hereby declared to be the
intention of the Town Board of Aldermen that the phrases, clauses, sentences,
paragraphs, and sections are severable, and if any phrase, clause, sentence, paragraph, or
section of this ordinance shall be declared unconstitutional by the valid judgment or
decree of any court of competent jurisdiction, such unconstitutionality shall not affect any
of the remaining phrases, clauses, sentences, paragraphs, and sections of this ordinance,
since they would have been enacted by the Town Board of Aldermen without the
incorporation in this ordinance of the unconstitutional phrase, clause, sentence, paragraph
or section.
SECTION 7: SAVINGS CLAUSE. All rights and remedies of the Town of
Westlake are expressly saved as to any and all violations of the provisions of the Code of
Ordinances, Town of Westlake, Texas, as amended, or any other ordinances affecting
such code which have accrued at the time of the effective date of this ordinance; and, as
to such accrued violations and all pending litigation, both civil and criminal, whether
pending in court or not, under such ordinances, same shall not be affected by this
ordinance but may be prosecuted until final disposition by the courts.
SECTION 8: PUBLICATION. The Town Secretary of the Town of Westlake
is hereby directed to publish in the official newspaper of the Town of Westlake, the
caption, penalty clause, publication clause and the effective date of this ordinance.
SECTION 9: EFFECTIVE DATE. This ordinance shall be in full force and
effect from and after its passage and publication as required by law.

Amendments to the
2006 International Building Code
(An option B Jurisdiction)
The following sections, paragraphs, and sentences of the 2006 International Building Code are hereby
amended as follows: Standard type is text from the IBC. Underlined type is text inserted. 'l ir,orl through

carried over from the 2003 edition of the code and a triple asterisk identifies a new or revised amendment
with the 2006 code. (The Town of Westlake is an option B Jurisdiction)
Explanation of Options A and B:
The majority of the following amendments were published and by the Regional Code Coordinating
Committee of the North Central Texas Council of Governments in an effort to coordinate the code
amendments for jurisdictions in the region. Please note that as there is a wide range in fire fighting
philosophies / capabilities of cities across the region, OPTION `A" and OPTION "B" are provided in the
Fire and Building Code amendments. Jurisdictions should choose one or the other based on their fighting
philosophies /capabilities when adopting code amendments.
Highlighted sections are changes from previous Westlake amendments.
Local Amendments note.
1. All buildings are required to be protected by an automatic fire sprinkler system. See the Westlake
Fire Code and amendments for provisions, and exceptions, relating to the requirements for the
installation of Automatic Fire Sprinkler systems.
**Section 101.4; change to read as follows:
101.4 Referenced codes. The other codes listed in Sections 101 .4.1 through 101.4.7 and referenced
elsewhere in this code, when specifically adopted, shall be considered part of the requirements of this
code to the prescribed extend of each such reference. Whenever amendments have been adopted to the
referenced codes and standards, each reference to said code and standard shall be considered to
reference the amendments as well. Any reference to NFPA 70 or the ICC Electrical Code shall mean the
Electrical Code as adopted.
(Reason: Legal wording to recognize locally adopted codes and amendments adopted with referenced
codes.)

***Section 901.6.1.1 Standpipe Testing; add section to read as follows:
901.6.1.1 Standpipe Testing. Building owners/managers must utilize a licensed fire protection
contractor to test and certify standpipe systems. In addition to the testing and maintenance requirements
of NFPA 25 applying to standpipe systems, the following additional_ requirements shall be applied to the
testing that is required every 5 years:
1. The piping between the Fire Department Connection (FDC) and the standpipe shall be
hydrostatically tested for all FDC's on any type of standpipe system. Hydrostatic testing shall also
be conducted in accordance with NFPA 25 requirements for the different types of standpipe
systems.
2. For any manual (dry or wet) standpipe system not having an automatic water supply capable of
flowing water through the standpipe, the contractor shall connect hose from a fire hydrant or
portable pumping system (as approved by the fire code official) to each FDC, and flow water
through the standpipe system to the roof outlet to verify that each inlet connection functions
properly. There is no required pressure criteria at the outlet. Verify that check valves function
Properly and that there are no closed control valves on the system.
3. Any pressure relief, reducing, or control valves shall be tested in accordance with the requirements
of NFPA 25.
4. If the FDC is not already provided with approved caps, the contractor shall install such caps for all
FDC's. Contact the Fire Marshal for additional information.
5. Upon successful completion of standpipe test, the contractor shall place a blue tag (as per "Texas
Administrative Code, Title 28. Insurance, Part I. Texas Department of Insurance. Chapter 34.
State Fire Marshal, Subchapter G. Fire Sprinkler Rules, 28 TAC § 34.720. Inspection, Test and

Maintenance Service (ITM) Tag") at the bottom of each standpipe riser in the building. An example
of this tag is located at the end of this SOP. The tag shall be check -marked as "Fifth Year" for Tyke
of ITM, and the note on the back of the tag shall read °5 Year Standpipe Test" at a minimum.
6. The contractor shall follow the procedures as required by "Texas Administrative Code, Title 28.
Insurance, Part 1. Texas Department of Insurance, Chapter 34. State Fire Marshal, Subchapter G.
Fire Sprinkler Rules, 28 TAC" with regard to Yellow Tags and Red Tags or any deficiencies noted
during the testing including the required notification of the local Authority Having Jurisdiction (Fire
Marshal).
7. Additionally, records of the testing shall be maintained by the owner and contractor, as required
by the State Rules mentioned above and NFPA 25.
8. Standpipe system tests where water will be flowed external to the building shall not be conducted
during freezing conditions or during the day prior to expected night time freezing conditions.
9. Contact the Fire Marshal for requests to remove existing fire hose from Class II and Ill standpipe
systems where employees are not trained in the utilization of this fire fighting equipment. All
standpipe hose valves must remain in place and be provided with an approved cap and chain when
approval is given to remove hose by the fire code official.
(Reason: Increases the reliability of the fire protection system and re-emphasizes the requirements of
NFPA 25.)
**Section 901.7; change to read as follows:
901.7 Systems out of service. Where a required fire protection system is out of service or in the event
of an excessive number of activations, the fire department and the code official shall be notified
immediately and, where required by the code official, the building shall either be evacuated or an
approved fire watch shall be provided for all occupants left unprotected by the shut down until the fire
protection system has been returned to service.
(Reason: Gives Fire Chief more discretion. Requires adoption of definition amendment in Section 202.)

The alarm device required on the exterior of the building shall be a weatherproof horn/strobe notification
appliance with a minimum 75 candela strobe rating, installed as close as practicable to the fire

faster access.)

905.2 Installation standards. Standpipe systems shall be installed in accordance with this section and
NFPA 14. Manual dry standpipe systems shall be supervised with a minimum of 10 psig and a maximum
of 40 Asia air pressure with a hiahilow alarm.
(Reason: To define manual dry standpipe supervision requirements.)

905.3.8: Building Area. In buildings exceeding 10,000 square feet in area per sto , Class I automatic
wet or manual wet standpipes shall be provided where any portion of the building's interior area is more
than 200 feet (60960 mm) of travel, vertically and horizontally, from the nearest point of fire department
vehicle access.
Exception; Automatic dry and semi-automatic dry standpipes are allowed as provided for in
NFPA 14.
(Reason: Allows for the rapid deployment of hoselines to the body of the fire.)

Exception: Existing systems need not comply unless the total buildinq remodel or expansion
initiated after the effective date of this code as adopted, exceeds 30% of the building. When
cumulative building remodel or expansion exceeds 50% of the building must comply within 18
months of permit application.
(Reason: Consistent with local practice.)

907.2.1 Group A. A manual fire alarm system shall be installed in Group A occupancies having an
occupant load of 300 or more persons or more than 100 persons above or below the lowest level of exit

The automatic operating mechanism of the smoke and heat vents shall operate at a temperature
rating at least 100 degrees (F) (approximately 38 degrees Celsius) greater than the temperature rating of
the sprinklers installed.
(Reason: Specifies a temperature range at which smoke and heat vents should activate in sprinklered
buildings to ensure that the sprinkler system has an opportunity to activate and control the fire prior to
vent operation. The intent is to allow the sprinkler system to operate prior to allowing the smoke and heat
vents to operate so as not to pose a detriment to the operation of the sprinkler system. This follows
recommendations indicated in NFPA 204, Section F.3 with regards to Design Considerations of smoke
and heat vents in sprinklered buildings. Full scale fire testing results have shown that smoke and heat
venting is potentially detrimental to the proper operation of the sprinkler system when vents are open prior
to sprinkler activation. This was a primary reason for removing smoke and heat venting requirements
with regards to ESFR sprinkler systems in Article 23 of the IFC for high -piled storage.)

SECTION 913
FIRE PUMP ROOM
913.1 General. Where provided, fire pumps shall be installed in a room designed and constructed in
accordance with this section, Section 913 of the International Fire Code and NFPA 20.
When located on the ground level at an exterior wall, the fire pump room shall be provided with an
exterior fire department access door that is not less than 3 ft. in width and 6 ft. — 8 in. in height, regardless
of any interior doors that are provided. A key box shall be provided at this door, as required by Section
506.1 of the International Fire Code.

wall, the corridor leading to the fire pump room access from the exterior of the building shall be

***Amend Section N7902.'1 Insulation and fenestration criteria. to read as follows:
1102.1 Insulation and fenestration criteria. The building thermal envelope shall meet the requirements
of Table N1102.1 based on the climate zone specified in Table N1101.2.
When compliance using Table 1102.1 is demonstrated with a ceiling R -value of R30 or less, no more than
33% of the total projected ceiling area may be of cathedral type construction (ceiling moist/roof rafter
assembly) and the required insulation R -value may be reduced to a minimum of R22 insulation when the
remaining ceiling area insulation is increased to R38.
(Reason: This amendment is compatible with the previous amendments increasing the number of
builders who could use the "simplified prescriptive" approach of the IRC and incorporates the Home
Builder Association prescriptive package proposal. The addition of "Ceiling Joist/Roof Rafter Assembly"
requirements protect such assemblies from the damage likely to occur if greater amounts of insulation
were attempted in such assemblies.)

N1102.3.6 Replacement fenestration. Where some or all of an existing fenestration unit is replaced with
a new fenestration product, including sash and glazing, the replacement fenestration unit shall meet the
applicable requirements for U -factor and s^'ar "oa+ 9aiR G99#„ eRt (SHG(;) in Table N 1102.1 N1102.3.7.
Exceptions:
1. Replacement skylights shall have a maximum U -factor for 0.60 when installed in all sub climate zones
except for 2.1.
2. For buildings constructed in conformance with an energy code as required by State of Texas Senate
Bill Number 5, 77 inLegislature, replacement fenestration units may comply with the original construction
documents or applicable U -factor in N1102.1.

N1102.3.7 Prescriptive path for additions. As an alternative to demonstrating compliance, additions
with a conditioned floor area less than 500 square feet (46.5 m2) to existing single-family residential
buildings and structures shall meet the prescriptive envelope component criteria in Table N1102.3.7 for
the sub climate zone applicable to the location. The U -factor of each individual fenestration product
windows, doors and sk li hts shall be used to calculate and area -weighted average fenestration product
U -factor for the addition, which shall not exceed the applicable listed values in Table N1102.3.7. For
additions other than sunroom additions the total area of fenestration products shall not exceed 40
percent of the gross wall and roof area of the addition. The R -values for opaque thermal envelope
components shall beequal to or greater than the applicable listed values in Table N1102.3.7.
Conditioned sunroom additions shall maintain thermal isolation shall not be used as kitchens or sleeping
rooms.
In sub climate zones 2.1, 2.2, 3.1, 3.2 and 3.3, the combined solar heat gain coefficient (the area
weighted average) of all glazed fenestration products used in additions and as replacement windows in
accordance with this section shall not exceed 0.40.

Amendments to the
2008 National Electrical Code
REGIONAL AMENDMENTS*
Section 230.77(A) add an exception.
230.71 Maximum Number of Disconnects.
(A) General. The service disconnecting means for each service permitted by 230.2, or for each set of
service -entrance conductors permitted by 230.40, Exception Nos. 1, 3, 4, or 5, shall consist of not more than
six switches or sets of circuit breakers, mounted in a single enclosure, in a group of separate enclosures, or
in or on a switchboard. There shall be no more than six sets of disconnects per service grouped in any one
location. For the purpose ... {text unchanged)... shall not be considered a service disconnecting means.
Exception: Multi -occupant Buildings. Individual service disconnecting means is limited to six for each
occupant. The number of individual disconnects at one location may exceed six.
REASON FOR CHANGE: This is currently the accepted installation practice of the region. No noteworthy
complaints have surfaced. It is more reasonable than the current NEC requirements. It allows more than
six disconnects grouped at one location. This also allows designers more flexibility in the placement of
electrical meters and main service disconnects.
**Section 300.79 add an exception.
300.11 Securing and Supporting.
(A) Secured in Place. Raceways, cable assemblies, boxes, cabinets, and fittings shall be securely
fastened in place. Support wires that do not provide secure support shall not be permitted as the sole
support. Support wires and associated fittings that provide secure support and that are installed in addition
to the ceiling grid support wires shall be permitted as the sole support. Where independent support wires
are used, they shall be secured at both ends. Cables and raceways shall not be supported by ceiling grids.
Exception: Ceiling grid support wires may be used for structural supports when the associated wiring is
located in that area not more than two raceways or cables supported per wire with a maximum nominal
metric desianation 16 (trade size Y21.
REASON FOR CHANGE: To provide limited support of raceways and cables by ceiling grid support wire.

permitted to be run in flexible metal conduit or an approved cable assembly that includes an equipment
grounding conductor within its outer sheath. The equipment grounding conductor shall comply with
25024(A)(5).
