RESOLUTION NO. 06-35
A RESOLUTION OF THE BOARD OF ALDERMEN OF THE TOWN OF WESTLAKE,
TEXAS, AUTHORIZING A CONTRACT WITH FINANCIAL INVOICING RESOURCES
ENGAGED, INCORPORATED (FIRE, INC.) FOR COST RECOVERING SERVICES
ASSOCIATED WITH FIRE AND RESCUE OPERATIONS.
WHEREAS, FIRE, Inc. is a Texas based corporation in the business of performing
cost recovery services associated with fire and rescue operations; and,
WHEREAS, the Board of Aldermen of the Town of Westlake desires to secure the
services of FIRE, Inc. for the purpose of providing the Town of Westlake with cost recovery
services incurred in the mitigation of fire and rescue related events; and,
WHEREAS, the contract with FIRE, Inc., is a fee based contract and incurs no costs for
the Town.
BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE TOWN OF WESTLAKE,
TEXAS:
SECTION 1: The above findings are hereby found to be true and correct and are
incorporated herein in its entirety.
SECTION 2: The Board of Aldermen of the Town of Westlake hereby approves the
contract with FIRE, Inc., attached as Exhibit "A", and further authorizes the Town Manger to
execute the contract on behalf of the Town of Westlake.
SECTION 3: This agreement shall be in effect from the date of execution until
terminated by any party to this agreement by written notice to the other parties stating the date of
such termination, with a minimum of a 60 day written notice given to terminate the agreement.

A CONTRACT FOR BILLING
Financial Invoicing Resources Engaged. Incorporated herein known as
"F.I.R.E., Inc.", is a corporation that desires to provide a billing cost recovery
service for the services rendered by
herein known as 'TIRE DEPARTMENT" to persons or entities requiring or requesting, said
services.
FIRE DEPARTMENT hereby authorizes F.I.R.E., Inc. to be the sole billing/cost recovery
entity for FIRE DEPARTMENT. FIRE DEPARTMENT authorizes F.I.R.E., Inc. to bill for
the services FIRE DEPARTMENT has provided to a person or entity within the jurisdiction of
FIRE DEPARTMENT. Billing will be based on a schedule of charges determined by FIRE
DEPARTMENT. FIRE DEPARTMENT authorizes F.I.R.E., Inc. to collect said monies from
insurance companies on behalf of FIRE DEPARTMENT. F.I.R.E., Inc. agrees to collect only
monies from the insurance company and wave all monies the insurance company does not pay
because of deductibles or lack or limitation of coverage unless FIRE DEPARTMENT has
directed to bill directly.
F.I.R.E., Inc. will forward to FIRE DEPARTMENT all monies collected within 15 days after
the end of month that the monies are deposited. F.I.R.E., Inc. agrees to deposit all monies in"a
fiduciary account. F.I.R.E., Inc. agrees to keep a separate accounting for FIRE
DEPARTMENT and provide to FIRE DEPARTMENT a photo or facsimile copy of the
document of deposit (check or electronic fund transfer document) from the insurance company.
For the services rendered by F.I,R.E., Inc. to FIRE DEPARTMENT, both parties agree that
F.I.R.E., Inc. will retain 15% (fifteen percent, 151100) of the monies collected on behalf of
FIRE DEPARTMENT for incidents that have occurred on or after the date listed Wow.
F.I.R.E., Inc. will retain 35% of any incident that occurred prior to the date listed below.
This contract begins on the date of signing and renews annually on the anniversary date of
signing unless either party notifies within sixty calendar days. in writing, the intent to cancel said
contract. Notification of intent to cancel can be without declared reason.
The undersigned representatives of F.I.R.E., Inc. and FIRE DEPARTMENT agree to all
conditions of this contract.
