RESOLUTION NO. 06-21
A RESOLUTION OF THE BOARD OF ALDERMEN OF THE TOWN OF WESTLAKE,
TEXAS, AUTHORIZING AN AMENDMENT TO THE FY 2005-06 ADOPTED BUDGET
BY INCREASING THE APPROVED FUNDING FOR ACCOUNT 43325 by $15,000 TO
PAY FOR ADDITIONAL LEGAL SERVICES ASSOCIATED WITH THE SPECIAL
SESSION OF THE TEXAS LEGISLATURE.
WHEREAS, the Board of Aldermen has contracted with the law firm of Akin Gump for
the services of Mrs. Jody Richardson to monitor legislation necessary to protect the interests of
the Town of Westlake; and
WHEREAS, The amount of funding approved by the Board in the adopted FY 2005-06
budget did not include funding for the third called session of the 791h legislature; and
WHEREAS, the Governor has convened the 79th legislature for a third called session
which has the potential to impact the Town of Westlake; and
WHEREAS, the Board of Aldermen desire that Mrs. Richardson monitor and report on
legislation through the special session of the legislature.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE
TOWN OF WESTLAKE, TEXAS:
SECTION 1. The above findings are hereby found to be true and correct and are
incorporated herein in its entirety.
SECTION 2. The Board of Aldermen of the Town of Westlake, Texas, hereby approve
the agreement with the law firm. of Akin Gump for the services of Jody Richardson, attached
hereto as Exhibit "A"; and further authorizes the Town Manager to execute the agreement on
behalf of the Town of Westlake, Texas.

Re: Legislative Representation of Town of Westlake
Dear Trent:
I am writing to verify the terms of our agreement relating to legislative representation of the Town of
Westlake ("Westlake" or the "Town"). During our recent telephone conversation we discussed the
special session of the Legislature that began this week. At your request, I researched our original
agreement, of 2001, and confirmed that it is silent with regard to special session work and legal fees.
We discussed legislation that could be considered and Westlake's response to it. We agreed that
Westlake will approach the special session with a measured response. You asked and I agreed to
provide you with a proposal for my time during the anticipated six week special session -and -a -half that
would be consistent with the Town's desired measured approach. We also agreed that if anything did
occur that would require a greater level of activity on my and on the Town's part, you and I would
confer immediately and decide upon any appropriate adjustment in approach and resulting fees_
We identified at least two issues that would be of great concern to Westlake if they were to be
addressed. One is anything dealing with charter schools and one is appraisal caps.
The proposal is to charge Westlake $15,000 for representing its interests during the third and predicted
fourth called session of the 791' Legislature. This flat fee enables the Town to have budgeting
certainly, and allows nrae to be as active as I should in order to learn of legislative initiates before they
become set in stone. Our existing agreement concerning expenses remains in place with no changes. If
the Town approves this proposal, we will bill you $5,000 for the month of April and $10,000 for the
month of May.
I look forward to talking with you after you have had a chance to discuss this special sessions issue
with the aldennen.
