RESOLUTION NO. 08-16
RELATING TO THE GIVING OF NOTICE OF INTENTION TO CREATE A
REINVESTMENT ZONE TO FINANCE IMPROVEMENTS WITHIN THE ZONE;
AUTHORIZING AND DIRECTING OTHER ACTIONS PRELIMINARY TO THE
CREATION OF THE PROPOSED REINVESTMENT ZONE; AND CONTAINING
FINDINGS RELATING TO THE FOREGOING SUBJECT.
WHEREAS, the Town of Westlake, Texas (the "Town"), pursuant to Chapter 312, Texas
Tax Code, as amended, is authorized to create a reinvestment zone; and
WHEREAS, the Board of Aldermen of the Town, in order to attract major investment in
the reinvestment zone that would be a benefit to the property to be included in the reinvestment
zone and would contribute to the economic development of the Town, has determined that it is in
the best interest of the Town to create a reinvestment zone to be designated as Reinvestment
Zone No. 3 (the "Reinvestment Zone") over an area to be described in the Ordinance that will
create the Reinvestment Zone; and '
WHEREAS, such Reinvestment Zone is eligible for commercial -industrial tax
abatement; and
WHEREAS, prior to the creation of the Reinvestment Zone the Town must hold a public
hearing on the creation of the proposed zone and its benefits to the Town and the property in the
proposed zone; and
WHEREAS, the Board of Aldermen of the Town has found and determined that a Notice
of Intention of the public hearing to create the Reinvestment Zone should be published in
accordance with the requirements of applicable law; and
WHEREAS, prior to the creation of the Reinvestment Zone other actions, including
delivering in writing notice of the public hearing to the presiding officer of the governing body of
each taxing unit levying taxes on the real property in the proposed reinvestment zone, shall be
taken, as appropriate;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE
TOWN OF WESTLAKE, TEXAS:
Section 1. The findings and determinations set forth in the preambles hereto are
hereby incorporated by reference for all purposes.
Section 2. A public hearing is hereby called on March 24, 2008 at 7:00 p.m. at the
regular meeting place of the Board of Aldermen of Westlake, Texas for the purpose of the
creation of Reinvestment Zone No. 3 within the Town and the Board of Aldermen of the Town is
hereby authorized and directed to issue a notice of intention to create a reinvestment zone in
substantially the following form:

NOTICE OF INTENTION TO CREATE A
REINVESTMENT ZONE IN THE TOWN OF
WESTLAKE, TEXAS
NOTICE IS HEREBY GIVEN that the Town of Westlake, Texas (the "Town") will hold
a public hearing to consider designating a certain area of the Town as a reinvestment zone (the
"Reinvestment Zone") pursuant to Chapter 312, Tax Code (the "Act") for the purpose of
financing and constructing public improvements within the Reinvestment Zone. The public
hearing will be held at the Board of Aldermen's regularly scheduled meeting at 7:00 p.m.
on Monday, March 24, 2008 at the Westlake Civic Campus -Board Room, 2600 J.T.
Ottinger Road, Westlake, Texas 76262. For information call 817-430-0941. The proposed
designation is generally located in the south, central portion of the Town. A map of the proposed
designation will be available for viewing at the Town Hall Offices, 3 Village Circle, Suite 202,
Westlake, Texas 76262.
THIS NOTICE is given in accordance with law and as directed by the Board of Aldermen
of Westlake, Texas.

Section 3. The foregoing notice shall be published in a newspaper of general
circulation in the area of the Town not later than the seventh day before the date of the hearing.
Section 4. The Town Secretary is hereby authorized to tape such actions as are
reasonably necessary preliminary to the creation of the proposed zone, including without
limitation, providing notice to taxing units levying taxes of real property within the proposed
zone as provided in Section 312.201(d)(2) of the Texas Tax Code, requesting waivers of notice
requirements and other related actions. To the extent any such notification or preparations have
occurred, such actions are hereby ratified by the Board of Aldermen.
Section 5. The Board of Aldermen officially finds, determines, recites and declares
that a sufficient written notice of the date, hour, place and subject of this meeting of the Board of
Aldermen was posted at a place convenient to the public at Town Hall, 2600 J.T. Ottinger Road,
Westlake, Texas 76262 for the time required by law preceding this meeting, as required by the
Open Meetings Law, Tex. Gov't Code Ann., ch. 551, and that this meeting has been open to the
public as required by law at all times during which this ordinance and the subject matter thereof
has been discussed, considered and formally acted upon. The Board of Aldermen further ratifies,
approves and confirms such written notice and the contents and position thereof.
Section 6. That this resolution shall take effect from and after the date of its passage.
