HomeMy WebLinkAboutOrd 683 Temporarily allowing the installation of a traffice control device at Dove Road and Randol Mill RoadTOWN OF WESTLAKE ORDINANCE NO. 683 AN ORDINANCE OF THE TOWN OF WESTLAKE TEMPORARILY AMENDING SECTION 90-52(b) OF THE CODE OF ORDINANCES OF THE TOWN OF WESTLAKE TO ALLOW FOR TEMPORARY TRAFFIC CONTROL DEVICE AT THE INTERSECTION OF DOVE ROAD AND RANDOL MILL — FACING A NORTHEAST DIRECTION; PROVIDING A SEVERABILITY CLAUSE; DECLARING A PENALTY; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the Town of Westlake is conducting road improvement construction on at on Dove Road within the corporate limits of the Town of Westlake; and WHEREAS, the Town has determined that a yield sign at the northeast facing direction of the intersection of Dove Road and Randol Mill Road is required for the project while under construction. WHEREAS, the Town Council seeks to temporarily amend its current traffic regulations by replacing the stop sign at the northeast facing direction of the intersection of Dove Road and Randol Mill Road with a yield sign for the duration of said construction. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF WESTLAKE, TEXAS: SECTION 1: That Chapter 90, "Traffic and Vehicles," of the Code of Ordinances of the Town of Westlake, Article Il, Division 2, Sec. 90-52(b) be temporarily amended as follows: At the traffic island intersection of Randol Mill Road and Dove Road facing the southeast and southwest on Randol Mill Road a stop sign shall be erected and at the northeast of Dove Road at Randol Mill Road a yield sign shall be erected. SECTION 2: Said Ordinance, being a penal ordinance, becomes effective ten (10) days after the date of passage by Town Council and shall automatically expire upon completion of the Dove Road improvement construction project. Thereafter, the yield sign traffic control device shall be replaced with a stop sign to regulate the flow of traffic. SECTION 3: The Town Manager is hereby authorized to cause to be erected appropriate signs indicating this yield intersection. SECTION 4: Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined a sum not to exceed the maximum amount allowed by law_ Ordinance 683 Page 1 of 2 SECTION 5: If any section, article, paragraph, sentence, clause, phrase or word in this Ordinance, or its application to any person or circumstance is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this Ordinance; and the Town Council hereby declares it would have passed such remaining portions of the Ordinance despite such invalidity, which remaining portions shall remain in full force and effect.
