RESOLUTION NO. 09-01
RATIFY THE EXECUTION OF THE APPROVAL AND EXECUTION OF AN
AMENDMENT TO THE AGREEMENT WITH TERRACON CONSULTANTS, INC.
FOR CONSTRUCTION MATERIAL TESTING SERVICE.
WHEREAS, the Town of Westlake is working to become leaders in premier educational
facilities and programs; and
WHEREAS, Westlake desires to produce well educated future leaders and thinkers; and
WHEREAS, Westlake desires to be business partners with Westlake Academy; and
WHEREAS, the Town Council finds that the material testing services in this agreement
for the Arts & Science Center benefits the public and is in the best interest of the public, citizens
of Westlake, Westlake Academy students and their parents.,-
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN
OF WESTLAKE, TEXAS:
,SECTION 1. All matters stated in the Recitals above are found to be true and correct and
are incorporated herein by reference as if copied in their entirety.
SECTION 2. The Town Council of the Town of Westlake hereby ratifies the approval
and execution of the agreement with Terracon Consultants, Inc., as it relate to the Arts & Sciences
Center construction of Phase I at the Civic Campus.

Dear Mr. Meyer:
Terracon Consultants, Inc. (Terracon) is pleased to submit this proposal to provide
construction materials testing services for the above referenced project. In this letter, we
present our understanding of the scope of the project, our proposed services, and a
budgetary estimate.
1.0 PROJECT INFORMATION—Exhibit"A"
The project consists of construction of Phase I of a new academic facility. The building
is supported on a drilled pier foundation system with a slab-on-ground. The frame is a
combination of wood and steel. Associated site improvements and pavement are also
included.
2.0 SCOPE OF SERVICES—Exhibit"B"
Terracon proposes to provide the following scope of services:
A. Earthwork
a) Sample materials proposed for use as subgrade, general fill, possible select fill,
trench backfill, and grade beam backfill materials. Prepare and test the samples for
Atterberg Limits (ASTM D4318), Material Finer Than Number 200 Sieve (ASTM
1140) and Moisture Density Relationship(ASTM D698).
b) Perform field moisture and density tests using the nuclear method (ASTM D6938)to
determine the moisture content and percent compaction of the soil materials, and
observation of the earthwork installation. Test frequency specified is 2,500 SF for
building footprint drain area, 5,000 SF for pavement subgrade and fill, and 100 LF for
utility trench backfill and grade beam backfill.

B. Drilled Piers
a) Monitor the installation of the drilled piers foundation system including verification of
the depth of the required bearing strata, total depth, pertinent elevations (if provided
by the field engineer), plumbness of the drilled pier hole excavation, cleanliness of
bearing surface at completion of drilling, etc.
b) Record dimensions and the number, size and length of reinforcing bars used.
c) Sample the fresh concrete and perform rewired tests, including slump, air content,
concrete temperature, and cast test specimens during placements (ASTM C172,
C31, 0143, 0231, and C1064).
d) Perform compressive tests of concrete test cylinders cast in the field (ASTM 0617,
C3g}.
C. Concrete
a) At the job site, monitor each load of concrete when not performing sample tests.
Sample the fresh concrete for each mix and perform required tests including slump,
air content, ambient and concrete temperature, and cast test specimens (4 cylinders
per 100 cy or fraction thereof per mix per day) during placements (ASTM 0172, C31,
0143, 0173, C1064).
Perform compressive tests of concrete test cylinders cast in the field (ASTM 0617,
C3g).
c) Provide periodic observation of batch plant operations was not included per our
discussion on this date.
d) Floor flatness testing was not included per our discussion this date.
D. Reinforcing Steel
a) Reinforcing Steel observation services will be provided solely by the Town of
Westlake
F. Structural Connections
a) Provide a certified welding inspector (CWI) at the job site to observe field welding
procedures and visually check bolted/welded connections in accordance with
applicable AISC and AWS specifications and contract documents.
Limitations of Authority of Terracon
1. Terracon is not authorized to release, revoke, alter, or enlarge requirements of the
Contract Documents.
2. Terracon will not approve or accept any portion of the Work. These services are
provided to verify compliance on a random basis at the frequency indicated. These
services do not relieve the Contractor of responsibility for compliance with the

Contract Document requirements.
, Terracon will not assume or perform any duties of the contractor.
4. Terracon has no authority to stop the work.
5. Terracon will perform observations, sampling and testing of materials and
construction as listed in the scope of work. Additional services will be provided when
required by the Architect/Engineer and authorized representative of the client.
6. Terracon is not responsible for site safety.
We re et a minimum of 24 hours notice to properly schedule our services.
3.0 PROJECT FEE
Our budgetary estimate for providing the above scope of services is $27,371.60. A
breakdown of the cast is attached. Please note that this estimate is based on the
quantity of hours and tests indicated in the attached cost breakdown. If these quantities
are exceeded at the request of the contractor and authorized by the Client, additional
fees will apply.
Services not included in this proposal; which may be requested by the client or its
representative, will be billed at Terracon's 2008 Standard unit rates, Overtime is defined
as all hours in excess of eight per day, outside of the normal hours of 7:00 a.m. to 5:00
p.m. Monday through Friday, and all hours worked on weekends and holidays. Overtime
rates will be 1.50 times the hourly rate quoted for work on Monday through Friday, and
2.0 times for Sundays and holidays. Hourly rates are invoiced portal to portal from our
facility. You will be invoiced on a monthly basis for services actually performed and/or as
authorized or requested by you or your representative.
4.0 AUTHORIZATION
This proposal may be accepted by executing both originals of the attached Agreement
for Consulting Services and returning one executed copy, along with this letter, to
Terracon. This proposal for services and accompanying limitations shall constitute the
terms and conditions for our services to be performed for this project. This proposal is
valid only if authorized within sixty days from the proposal date. Terracon's total fee is
due within thirty days following receipt of invoice.

Clarifications and Assumptions
1. The testing and inspection in this proposal estimate represents all the testing and inspection services to be provided
on this project unless additional services are requested by the client. No other testing or inspection of any kind
whatsoever is included in this proposal estimate.
2. We obtained estimated quantities from a review of the project drawings and specifications,and our past experience
with similar projects.
1 We have assumed 8 working days to complete the piers.
4. We have assumed in-place density tests at one per 2,500 sf for the building,one per 5,000 sf for paving,and one per
100 If for utility and retaining wall backfill backfill.
5. We have assumed a concrete test frequency of one set of 4 cylinders per 100 cy.We have not included any time for concrete
batch plant observation based on our phone conversation this date.
& We have assumed one stab placements with no floor flatness required per our conversation this date.
7. We have assumed periodic observation of masonry for retaining walls(3 trips).

Our dispatcher can be reached directly at(817)589-01167. We require one days notice(24 hours)for our services. All
services must be scheduled through our dispatcher. Cancellations shall also be through our dispatcher. Our dispatch
is available between the hours of 7:00 am to 5:00 pm. After hour calls are handled by our voice mail system. It is
recommended that you schedule services through our dispatch during our regular working hours noted above. Voice mail
is checked the following morning. Same day call-ins or after hour voice mail call-ins for work the following day are subject
to the availability of personnel. We cannot guarantee service for same day call-ins-
Reinforcing Steel inspections must be scheduled separately from concrete placement. Adequate daylight hours are
required in advance of concrete placement for scheduled reinforcing steel inspection.
We recommend that there be a Pre-Construction Meeting. We request that we are invited to
attend this meeting. A project manager will be assigned to your project and will attend the pre-construction meeting.
During the project,the project manager will be available to answer any questions you may have concerning our service.
To aid us in assisting you on your project we request a copy of specifications and two sets of plans(one half-size set,If
available,for the field and one full-size set for the office). We also request copies of any addenclums,plan changes,
or RFI's that are pertinent to our scope of work,
Compensation for our services will be based upon the actual work and tests performed in accordance with the unit rates
shown. The estimated costs we have indicated are approximate. ESTIMATED TOTAL COST does not include:any casing
of the drilled piers;any retests or inspection;or any changes to the contract documents, Invoices for our services are payable
within 30 days with no retainage.
A six(6)hour minimum technician charge is applicable for all tips made for the performance of testing,inspection or
consulting services,unless noted otherwise, The minimum charge is not applicable for trips to the project site for
sample pick up only.
Overtime rates,at 1.6 times the normal rate,will be applied for all hours worked in excess of eight(8)hours per day,all hours
prior to 07:00 AM and after 05:00 PM Monday through Friday,and all hours worked on Saturday. Holidays and Sundays
will be charged at 2.0 times the quoted hourly rates.
Rush testing and inspections wiU be subject to a surcharge(to be negotiated).
All labor,equipment,and transportation charges are billed on a portal to portal basis from our
office.
