HomeMy WebLinkAboutAM Mutual Boundary Adjustment Agreement City of Keller Bradley propertyTo: Honorable Mayor and Board of Aldermen From: Trent Petty, Town Manager Stan Lowry, Town Attorney Subject: Regular Board Meeting, April 9, 2001 Date: April 4, 2001 Consider a resolution approving a Mutual Boundary Adjustment Agreement pursuant to Section 43.031 of the Texas Government Code, between the Town of Westlake and the City of Keller. The Town of Westlake and City of Keller have determined that it would be in each community's respective interests to have the property currently owned by Scott and Kelly Bradley located entirely within the municipal boundaries of the Town of Westlake. Section 43.031 of the Texas Local Government Code allows adjacent municipalities to make mutually agreeable boundary adjustments to the extent that the property is no greater than 1,000 feet in either direction. In this regard, the City of Keller, on Tuesday, March 20, 2001, passed a Resolution approving the Mutual Boundary Adjustment Agreement that is included herewith. In addition, Scott and Kelly Bradley have agreed to dedicate a 25 -foot wide sanitary sewer easement to the Town of Westlake for the mutual benefit of the Town of Westlake and the City of Keller. If this Mutual Boundary Adjustment Agreement is adopted by the Board of Aldermen, the Town Manager will then provide a letter to the City of Keller stating that it has the mutual use of the 25 -foot sanitary sewer easement referenced above. The approval of this Resolution and Mutual Boundary Adjustment Agreement will allow the Town access to acquire this easement at no cost to the Town thus saving money in the water and sewer utility fund.
