Consider a Resolution regarding the state's right-of-way on old U.S. Hwy. 377.
COMMENDATION
Staff recommends passage of the resolution, so TxDOT will move forward on the quitclaim of
the aforementioned land.
BACKGROUND
The Town has requested of the Texas Department of Transportation (TxDOT) 2.03 acre tract of
land consisting of old Highway 377 right-of-way (legal description and exhibit attached) be
quitclaimed to the Town. The right-of-way is no longer being used by TxDOT. The local
district right-of-way department of TxDOT has spent the last year researching whether they
would be able to quitclaim the land to the Town; and they believe they can.
TxDOT has requested in a letter attached that a resolution from the Town agreeing to accept the
land be adopted by the Town. The draft resolution is attached. The remainder of the process is
outlined in a document sent by TxDOT,which is also attached.
The cost of the land shall be the fair market value as determined by an appraisal done by
TxDOT.
The timing of the completion of this quitclaim is highly variable, since it must go to Austin and
be signed by the Governor.
