ORDINANCE NO. 874
AN ORDINANCE OF THE TOWN COUNCIL OF THE TOWN OF WESTLAKE,TEXAS,
CALLING AND ORDERING AN ELECTION FOR THE PURPOSE OF ELECTING
THREE (3) COUNCIL MEMBERS TO BE HELD ON MAY 4, 2019, IN ACCORDANCE
WITH THE PROVISIONS OF SECTION 23.023, TEXAS LOCAL GOVERNMENT
CODE; ESTABLISHING PROCEDURES FOR THE ELECTION; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the general election for the Town of Westlake as set forth by the Texas
Election Code, is required to be held on May 4, 2019, for the purpose of electing three (3) Council
Members for two (2) year terms; and
WHEREAS, in accordance with Section 271.002 of the Texas Election Code , the Town
of Westlake election will be conducted jointly with other political subdivisions in Tarrant and
Denton counties.
NOW,THEREFORE,BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF
WESTLAKE, TEXAS, THAT:
SECTION 1: Election Order for General Election. That an election is hereby ordered
to be held on the 4th day of May 2019, the second Saturday of that month, for the purpose of
electing three (3) Council Members for two (2) year terms, in accordance with Section 23.023 of
the Texas Local Government Code.
SECTION 2: Polling Place. The polling places and the county elections precincts whose
qualified voters shall cast ballots at such location as determined per the Joint Election Agreement
and Contract for Elections Services with the Tarrant and Denton County Election Administrators.:
The polls shall be open from 7:00 a.m. to 7:00 p.m. on May 4, 2019, in accordance with and
pursuant to the requirements of the Texas Election Code (the "Code").
SECTION 3: Filing Dates. In accordance with Section 143.007 of the Code, eligible
persons wishing to become candidates must file an application with the Town Secretary of the
Town of Westlake,Texas,beginning on January 16,2019 through the February 15,2019 until 5:00
p.m. Each application shall be on a form meeting the requirements of the Code.
SECTION 4: Combined Ballots. Combined ballots may be utilized containing all of the
offices and propositions to be voted on at each polling place, provided that no voter shall be given
a ballot or permitted to vote for any office or proposition on which the voter is ineligible to vote.
The County's voting equipment will be utilized for this election.

SECTION 5: Early Voting. Early Voting by personal appearance shall be conducted at
the County's Main Early Voting location;

and branch offices for early voting by personal appearance shall be established as outlined in the
Election Agreement and Contract for Election Services with Tarrant and Denton County. The
Early Voting locations/dates/times will be set as per the agreement/contract with Denton County
Elections. Tarrant County Elections Administrator and Denton County Election Administrator are
hereby appointed as the Early Voting Clerk and can appoint the necessary deputy clerks as required
for early voting. In accordance with Section 85.001 of the Texas Election Code, early voting by
personal appearance tentative schedule is set forth below:
Tarrant County Early Voting
April 22-26 (Monday-Friday) 8:00 a.m. - 5:00 p.m.
April 27 (Saturday) 7:00 a.m. - 7:00 p.m.
April 28 (Sunday) 11:00 a.m. - 4:00 p.m.
April 29-30 (Monday—Tuesday) 7:00 a.m. - 7:00 p.m.
Denton County Early Voting
April 22—April 27 (Monday— Saturday) 8:00 a.m. - 5:00 p.m.
April 29-30 (Monday—Tuesday) 7:00 am. - 7:00 p.m.
Applications for ballots by mail must be received no later than the close of business on April 23,
2019.
SECTION 6: Notice. Notice of said elections shall be given as required by the Texas
Election Code.

SECTION 7: Election Officials. The election judge, alternate election judge, and ballot
board will be appointed by the Tarrant and Denton County Elections Administrator, as permitted
by law. The presiding judge shall appoint elections clerks as may be necessary for the proper
conduct of the election. The election judge or the alternate election judge in the absence of the
election judge, and the election clerks shall constitute the early voting ballot board. The election
judge, and alternate election judge, and election clerks shall be qualified voters of the Town.
SECTION 8: Election Results. That the candidates for Council who receive the highest
number of votes shall be elected to two (2) year terms;
The Mayor shall deliver a certificate of election to the successful candidates. In the event
of a tie, the tied candidates shall cast lots to determine which one shall be declared elected; and
SECTION 9: Governing Law. The election shall be held in accordance with the
Constitution of the State of Texas and the Texas Election Code, and all resident qualified voters
of the Town shall be eligible to vote at the election.
SECTION 10: Submission to the United States Justice Department. The Town
Secretary of the Town of Westlake, Texas, or the Town Attorney, is authorized to make such
submissions as are necessary to the United States Justice Department to seek pre-clearance as
required by law.
SECTION 11: Necessary Actions. The Mayor and the Town Secretary, in consultation
with the Town Attorney, are authorized and directed to take all actions necessary to comply with
the provisions of the Texas Election Code, and the Town Code in carrying out and conducting the
election, whether or not expressly authorized by this Order.
SECTION 12: Severability Clause. It is hereby declared to be the intention of the Town
Council that the sections, paragraphs, sentences, clauses and phrases of this order are severable
and if any phrase, clause, sentence, paragraph, or section shall be declared invalid or
unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences,
paragraphs and sections of this order, since the same would have been enacted by the Town
Council without the incorporation in this order of any such invalid or unconstitutional phrase,
clause, sentence, paragraph or section.

SECTION 13: Effective Date. This order shall be effective upon its adoption.

UNA ORDENANZA DEL AYUNTAMIENTO DE LA CIUDAD DE WESTLAKE,
TEXAS, LLAMAR Y PEDIR UNA ELECCION CON EL FIN DE ELEGIR A TRES 3
MIEMBROS DEL CONSEJO QUE SE REALIZARA EL 04 DE MAYO DE 2019, CON
ARREGLO A LAS DISPOSICIONES DE LA SECCION 23.023, CODIGO DE
GOBIERNO LOCAL DE TEXAS; ESTABLECER PROCEDIMIENTOS PARA LA
ELECCION; Y PROPORCIONAR UNA FECHA EFECTIVA.
Considerando que, las elecciones generales para la ciudad de Westlake establecidas por
el codigo electoral de Texas, es necesario que se realizara el 04 de mayo de 2019, con el fin de
elegir a tres 3 miembros del Consejo para periodos de dos 2 anos; y
Considerando que, de acuerdo con la seccion 271.002 del codigo electoral de Texas, la
eleccion de la ciudad de Westlake se llevara a cabo conjuntamente con otras subdivisiones
politicas en los condados de Tarrant y Denton.
AHORA, POR LO TANTO, SER ORDENADO POR EL AYUNTAMIENTO DE LA
CIUDAD DE WESTLAKE,TEXAS, QUE:
Seccion 1: Orden de la eleccion para eleccion General. Se ordena que una eleccion se celebre
el 4 de mayo de 2019, el segundo sabado de ese mes, con el fin de elegir a tres (3) Miembros del
Consejo por un termino de dos (2) anos, de acuerdo con la Seccion 23.023 del Codigo de
Gobierno Local de Texas.
Seccion 2: Votacion. Lugares de el centro de votacion y el recinto de elecciones del Condado
cuyos votantes calificados votaron en dicha localizacion segun lo determinado por el acuerdo
conjunto de elecciones y contrato para servicios de elecciones con el Tarrant y Denton County
los administradores electorales.:
Las urnas seran abiertas de 7:00 am a 7:00 pm en 04 de mayo de 2019, de acuerdo con y
conforme a los requisitos del codigo electoral de Texas (el "codigo").
Seccion 3: Las fechas de presentacion. De acuerdo con la seccion 143.007 del codigo, las
personas elegibles que deseen ser candidatos deben presentar una solicitud con el Secretario de la
ciudad de la ciudad de Westlake, Texas, a partir del 16 de enero de 2019 a traves el 15 de febrero
de 2019 hasta 5:00 p.m. Cada aplicacion debera ser en forma cumpliendo de los requisitos del
codigo.
Seccion 4: Combinado papeletas. Combinado las papeletas pueden ser utilizadas con todas las
oficinas y propuestas a votarse en cada lugar de votacion, siempre que ningtln elector sera dado
una boleta o permitido para votar por cualquier oficina o de la propuesta en la que el elector es
elegible para votar. El equipo de votacion del condado se utilizaran para esta eleccion.

Seccion 5: La votacion anticipada. Votacion temprana en persona se realizara en el lugar
principal de votacion temprana del Condado;

y se estableceran oficinas de votacion temprana en persona como se indica en el acuerdo de
eleccion y contrato para los servicios de eleccion con Tarrant y Denton County. Las votacion
temprana ubicaciones/fechas se establecera segun el acuerdo/contrato con elecciones del
Condado de Denton y Tarrant. Administrador de elecciones del Condado de Tarrant y
administrador de elecciones del Condado de Denton son designados por la presente como la
votacion adelantada, puede designar al diputado necesario secretarios como sea necesario para la
votacion temprana. Segun 85.001 seccion del codigo electoral de Texas, la votacion anticipada
por apariencia personal tentativo horario se establece a continuacion:

Solicitudes de voto por correo deben recibirse no más tarde del cierre de actividades el 23 de
abril de 2019.
Seccion 6: Nota. Se darn aviso de elecciones tales como lo exige el codigo electoral de Texas.
Seccion 7: Oficiales. El juez electoral, Juez suplente electoral y junta electoral seran nombrados
por el Tarrant y administrador de elecciones del Condado de Denton, en la medida permitida por
la ley. El juez designara a secretarios de elecciones que sean necesarias para el buen desarrollo
de las elecciones. El juez electoral o al juez de eleccion alternativa en ausencia del juez electoral
y los secretarios de elecciones constituiran la Junta de boleta electoral temprana. El juez de la
eleccion y Juez suplente electoral y secretarios de elecciones serail votantes calificados de la
ciudad.

Seccion 8: Resultados de las elecciones. Que los candidatos para el Consejo que reciben el
mayor numero de votos seran elegidos para periodos de dos 2 anos;
El alcalde emitira un certificado de eleccion a los candidatos. En caso de empate, es hara
un sorteo entre los candidatos empatados para determinar cual sera declarado electo; y
Seccion 9: Ley aplicable. La eleccion se celebrara de conformidad con la Constitucion del
estado de Texas y el codigo electoral de Texas, y todos los votantes elegibles residentes de la
ciudad podran votar en las elecciones.
Seccion 10: Presentacion al Departamento de Justicia de Estados Unidos. El Secretario de la
ciudad de la ciudad de Westlake, Texas, o el abogado de la ciudad, esta autorizado a realizar
dichos envios que sean necesarios para el Departamento de Justicia de Estados Unidos para
solicitor permiso previo como exige la ley.
Seccion 11: Acciones. El alcalde y el Secretario de la ciudad, en consulta con el abogado de la
ciudad, estan autorizados y dirigidos a tomar todas las medidas necesarias para cumplir con las
disposiciones del codigo electoral de Texas y el codigo de ciudad llevando a cabo y llevar a cabo
la eleccion, o no autorizados expresamente por esta orden.
Seccion 12: Clausula salvatoria. Se declara que la intencion del Ayuntamiento que las
secciones, parrafos, oraciones, clausulas y frases de este orden son divisibles y si cualquier frase,
clausula, frase, parrafo o seccion sera declarada invalida o inconstitucional por el juicio valido o
decreto de cualquier Tribunal de jurisdiccion competente, dicha invalidez o inconstitucionalidad
no afectara a ninguna de las restantes frases, clausulas, oraciones, parrafos y secciones de esta
orden, ya que el mismo habria sido promulgado por la ciudad Consejo sin la incorporacion en
este orden de cualquier validez o inconstitucional frase, clausula, frase, parrafo o seccion.
Seccion 13: Fecha. Esta orden entrara en vigor tras su aprobacion.
