Others: Alternates Ken Kraska and Sharon Sanden ABSENT: Tim Brittan and Greg Goble OTHERS PRESENT: Town Attorney Cathy Cunningham, Director of Planning Ron Ruthven, Town Secretary Kelly Edwards, Administrative Assistant to the Town Secretary Tanya Morris, Fire Chief Richard Whitten, Deputy Chief John Ard, Communications Director Ginger Awtry, Communications Manager Jon Sasser, Director of Public Works Jarrod Greenwood, Director of Information Technology Jason Power, Director of Finance Debbie Piper, Building Official Pat Cooke, and Development Coordinator Nick Ford. Work Session 1. CALL TO ORDER Commissioner Lee called the work session to order at 5:01 p.m. 2. EXECUTIVE SESSION The Commission convened into executive session at 5:02 p.m. The Commission will conduct a closed session pursuant to Texas Government Code, annotated, Chapter 551, Subchapter D for the following: a. Sec. 551.071. Consultation with Attorney (2) on a matter in which the duty of the attorney to the governmental body under the Texas Disciplinary Rules of P&Z Minutes 10/16/17 Page 1 of 5 Professional Conduct of the State Bar of Texas clearly conflicts with this chapter: Zoning and the Comprehensive Plan 2. RECONVENE MEETING Commissioner Lee reconvened the work session at 6:10 p.m. 3. ADJOURNMENT Commission Lee adjourned the work session at 6:10 p.m. Regular Session 1. CALL TO ORDER Commissioner Lee called the regular session to order at 6:10 p.m. 2. DISCUSSION AND CONSIDERATION OF THE MINUTES FROM THE MEETING HELD ON AUGUST 14, 2017. MOTION: Commissioner Groce made a motion to approve the minutes. Commissioner Sanden seconded the motion. The motion carried by a vote of 5-0. 3. DISCUSSION AND CONSIDERATION OF THE MINUTES FROM THE MEETING HELD ON AUGUST 28, 2017. MOTION: Commissioner Garvin made a motion to approve the minutes. Commissioner Groce seconded the motion. The motion carried by a vote of 5-0. 4. DISCUSSION AND CONSIDERATION OF THE MINUTES FROM THE MEETING HELD ON AND SEPTEMBER 18, 2017. MOTION: Commissioner Kraska made a motion to approve the minutes. Commissioner Garvin seconded the motion. The motion carried by a vote of 5-0. Commissioner Lee announced that the Commission would hold a joint public hearing for items 5 and 6 on the agenda. CONDUCT A PUBLIC HEARING AND CONSIDER APPROVAL OF AN AMENDMENT TO THE COMPREHENSIVE PLAN, AMENDING THE LAND USE MAP CONTAINED WITHIN. THE CHANGES ARE LIMITED TO AN APPROXIMATELY 62.53-ACRE PORTION OF LOT 1, BLOCK 3, WESTLAKE/SOUTHLAKE PARK #1, LOCATED ALONG THE SOUTH SIDE OF SOLANA BLVD., WEST OF THE INTERSECTION OF SAM SCHOOL ROAD AND SOLANA BLVD. Director Ruthven provided a presentation and overview of the item. Commissioner Lee moved to item 6. MOTION: Commissioner Kraska made a motion to deny the amendment to the comprehensive plan. The motion died for a lack of second. MOTION: Commissioner Groce made a motion to table, re-open and continue the public hearing on November 13, 2017. Commissioner Garvin seconded the motion. The motion carried by a vote of 4-1-0. Commissioner Kraska opposed the motion. Commissioner Lee returned to item 6 to call for a motion. 6. CONDUCT A PUBLIC HEARING AND CONSIDER RECOMMENDATION OF A ZONING CHANGE REQUEST FOR AN APPROXIMATELY 62.53-ACRE PORTION OF LOT 1, BLOCK 3, WESTLAKE/SOUTH LAKE PARK #1, LOCATED ALONG THE SOUTH SIDE OF SOLANA BLVD., WEST OF THE INTERSECTION OF SAM SCHOOL ROAD AND SOLANA BLVD. THE PROPERTY IS CURRENTLY ZONED PLANNED DEVELOPMENT DISTRICT (PD1-1); PROPOSED ZONING: PLANNED DEVELOPMENT DISTRICT (PD6) FOR SINGLE FAMILY RESIDENTIAL USES, INCLUDING A REQUEST FOR APPROVAL OF A CONCEPT PLAN AND DEVELOPMENT PLAN; APPROVAL OF A SPECIFIC USE PERMIT FOR PRIVATE STREETS. Director Ruthven provided a presentation and detailed overview of the item. Larry Corson, Wilbow Corporation, provided a presentation and overview of the proposed development, including an updated proposal. Mike Hudspeth, BRE Solana, supports the proposed development and provided an overview of the current zoning of the property. Discussion ensued regarding visitor parking location, 1-story/2-story homes along the boundary, ridgeline boundary location, impact on east and west knolls, widths of streets, P&Z Minutes 10/16/17 Page 3 of 5 height of trees in green space vs. height of homes proposed, concrete streets opposed to asphalt streets, and speculated construction. Commissioner Lee opened the joint public hearing for items 5 and 6. Recess 7:56 p.m. - 8:04 p.m. The following people spoke in favor of the zoning change: Vik Suresh, 2042 Valencia Cove; Curt Dubose, 2210 Costa Del Sol; Mike Pacillio, 2209 Vaquero Estates Boulevard; James Hamilton, 2026 Valencia Cove; and Paul Beauchamp, 1857 Broken Bend Drive. The following people spoke in opposition of the zoning change: Jay Still, 1813 Broken Bend Drive; Melanie Stevenson, 1823 Broken Bend Drive; David Riley, 1821 Broken Bend Drive; Pat Cockrum, 1825 Broken Bend Drive; Scott Bradley, 1 Paigebrook; Yair Lotan, 1809 Broken Bend Drive; Brad Samargya, 2021 Valencia Cove; Andrew Kuster, 1803 Shady Grove Court; David Ramey, 2006 Valencia Cove; Nolan Ogden, 1829 Broken Bend Drive; Charles Hamby, 1839 Broken Bend Drive; Denny Iker, 1814 Broken Bend; Stephanie Mauler, 1855 Broken Bend Drive; Tim Shiner, 1606 Fair Oaks Drive; Joe Mohan, 1806 Copperfield Court; Ray Oujesky, 201 S. Main Street, Suite 2500, Fort Worth, Texas 76102; Neil McNabnay, 1815 Broken Bend; and Colin Stevenson, 1823 Broken Bend Drive. The following people did not speak, but completed a speaker form in opposition of the zoning change: Jana Still, 1813 Broken Bend Drive; Chad Stevenson, 1823 Broken Bend Drive; Andy Sedino, 1604 Creekwood Court; Harry Dombroski, 1808 Broken Bend Drive; Jan Dombroski, 1808 Broken Bend Drive; Crystal Shiner, 1606 Fair Oaks Drive; Maria Mohan De Leon, 1806 Copperfield Court; Elizabeth Litwin, 2002 Valencia Cove; Sandra Lotan, 1809 Broken Bend Drive; Horace Wu, 1849 Broken Bend Drive; Christy Renda, 1804 Copperfield Court; David Riley, 1821 Broken Bend Drive; Anders Svensson, 1853 Broken Bend Drive; and Judy Havenstein, 2211 Cedar Elm Terrace. Recess 9:16 p.m. — 9:22 p.m. Commissioner Lee closed the public hearing joint public hearing for items 5 and 6. Larry Corson, Wilbow Corporation, gave a rebuttal in regards to the speakers in opposition of the proposed development. Commissioner Lee returned to item 5 to call for a motion. MOTION: Commissioner Groce made a motion to table, re-open and continue the public hearing on November 13, 2017. Commissioner Garvin seconded the motion. The motion carried by a vote of 4-1-0. AD3OURNMENT There being no further business to come before the Commissioners, Commissioner Lee asked for a motion to adjourn. MOTION: Commissioner Sanden made a motion to adjourn the meeting. Commissioner Kraska seconded the motion. The motion carried by a vote of 5-0.
