Res 17-30 Authorizing the Town Manger to amend an agreement with Brown Reynolds Watford
TOWN OF WESTLAKE RESOLUTION NO. 17-30 A RESOLUTION AUTHORIZING THE TOWN MANAGER TO AMEND THE AGREEMENT FOR PROFESSIONAL ARCHITECTURAL DESIGN SERVICES WITH BROWN REYNOLDS WATFORD ARCHITECTS TO PROVIDE ADDITIONAL DETAIL TO CREATE THE ICONIC LOOK DESIRED AND MEET THE HIGH WESTLAKE STANDARDS FOR THE WESTLAKE FIRE-EMS STATION NO. 1 AND AUTHORIZE TOWN MANAGER TO MAKE FUNDING CHANGES NOT TO EXCEED $25,000 ON THIS PROJECT. WHEREAS, on December 12, 2016, Resolution 16-43, authorized the Town Manager to enter into a professional architectural design services agreement with Brown Reynolds Watford Architects (BRW) firm to complete the Westlake Fire/EMS Station No. 1 for a total of $638,000.00; and, WHEREAS, on April 3, 2017 the Council gave staff the direction to proceed with the additional project scope and funding for the fire station; and, WHEREAS, to ensure the station has the iconic look desired and to stay true to high Westlake standards; and, WHEREAS, amending of this agreement with Brown Reynolds Watford Architects would provide the additional detailed drawings and professional architectural design services needed to ensure the station has the iconic look desired and to stay true to high Westlake standards; and, WHEREAS, the Town Council finds that the passage of this resolution is in the best interest of the citizens of Westlake. NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF WESTLAKE, TEXAS: SECTION 1: That, all matters stated in the Recitals hereinabove are found to be true and correct and are incorporated herein by reference as if copied in their entirety. SECTION 2: That the Town of Westlake Town Council hereby approves amending the agreement with Brown Reynolds Watford Architects to provide professional services for concept design of the iconic Town of Westlake Fire EMS Station No. 1 and authorize the Town Manager to make funding changes not to exceed $25,000 on this project., attached as Exhibit "A. Resolution 17-30 Page 1 of 2 SECTION 3: If any portion of this Resolution shall, for any reason, be declared invalid by any court of competent jurisdiction, such invalidity shall not affect the remaining provisions hereof and the Council hereby determines that it would have adopted this Resolution without the invalid provision. As follows: PROJECT SCOPE MODIFICATIONS 1. BRW Architects will provide basic design and construction services as described in our original contract to accommodate the expanded project program and siteibuilding design,including an enhanced architectural character,as allowed by the Owner's budget for the Cost of the Work increasing from$6,600,000.00 to approximately$9,100,000.00. The expanded project scope excludes design of anew cell phone tower. 2. BRW Architects will also provide three(3)high-quality exterior building renderings with views as selected by the Owner 3. The project scope for the Hose and Stair Tower is eliminated. The following adjustments shall be made to compensation and time. (Insert provisions in accordance with the Agreement, or as otherwise agreed by the parties.) Compensation: Lump Sum Fee Modifications: 1. Project scope increase $95,000.00 Add 2. Renderings $ 4,500.00 Add 3. Hose and Stair Tower ($16,500.00) Deduct Total Contract Increase $83,000.00 Other terms, fees and expenses in our original contract shall remain the same.
