Planned Use of Data- The requirements established in United States Code Annotated,Title 20,Education,
Chapter 31,Subchapter III,Section 1232(e)stipulate that"Each local education agency which participates in an
applicable program under which feder,.l funds are made available to such agency through a State agency shall
submit,to such agency or board,a general application containing the assurances set fortll in subsection(b)of th is
section,."The application shall covet the participation by the local education agency in all federal programs
administered by the U.S.Department of Education.
Instructions This general application will be in effect for the duration of participation in federal programs until
such time as the requirements change_ The superintendent or other authorized officer must sign the certification
and return to the address below. Payment for federally funded applications and contracts cannot be made by this
Agency until the general application is received. For further information,contact the Division of Contracts and

The General Application of Assurances for Federal Programs fond is being
faxed to you. Please complete and return the form. Although you are asked
for your county-district number in the right comer of the fon-n, it is
understood that you have not yet received a contract or been issued a county-
district numbe)r. Agency staff will add the county-district number to the form
once it is assigned. This form is significant because you are Ineligible for
any federal monies including the Title X start-up funds without theses
assurances.
The contract will be issued when all contingencies are cleared. If you have

It is imperative that the form contain an original signature.

ASSURANCES
Assurance is hereby given that:
i. the local educational agency will administer each pro_*Tam covered by the application in accordance with all
applicable state tes, regulations,program pians,and applications;
2. the control of funds prorded to the local educational agency under each program,and title to property acquired
with those funds,will be in a public agency and a public agency will adrninisterthose funds and property;
3. the local educational agency will use fiscal control and fund accounting procedure>that will assure proper
disbursement of,and accounting for,Fedcral funds paid to thzt agency under each program;
4. toe local educational agency will make reports to the Texas Education.Agency or State Board of Education and
to the Secretary of Education as may reasonably be necessary to enable the Texas Education Agency or State
Sward of Education and the Secretary of Education to perform their duties and the local educational agency will
maintain such records,including the records required under section 1232f"of this title,and provide access to
those records,as the Texas Education Agency or State Board of Education or the Secretary of Education deem
necessary to perform their duties;
3. the local educational agency will,provide reasonable opportunities for the participation by teachers,parents,and
other interested agencies,organizations,and individuals in the planning,for and operation of each program;
6any application,evaluation,periodic program pian or report relating to each program will be made readily
available to parents and other members of the general public;
7, in the case of any project involving construction-
(A) the project is not inconsistent with overall State plans for the construction of school facilities,and
(8) in developing plans for construction,due consideration will be given to,excellence of architecture and
design and to compliance with standards prescribed by the Secretary of Education under section 794 of
Title 29 in order to ensure that facilities constructed with the use of Federal funds are accessible to and
usable by.individuals with disabilities;
S. the'local educational agency has adopted effective procedures for acquiring and dissemitrating to teachers and
administrators participating in each program significant information from educational research,demonstrations,
and similar projects,and for adopting,where appropriate,promising educational practices developed through
such projects;and
4. none of the funds cxuonded under anv anolicable orosratn will be used to accuire eouioment finciudins
computer sof twwc)in any instance in which such acquisition results in a direct financial benefit to any
organization representing the interests of the purchasing entity or its employees or any affiliate of such an
arganimition.

RECORDS
Each recipient of Federal funds under any applicable Frearn through zny grant subgraw, cooperative
agreement, loan,or outer arrangement shall keep records which fully disclose the anraurt and imposition by the
recipient of those funds, and the total cost of the activity for which thr_ funds are used,the share of that cost
provided front other 5eurces, and such other records as will facilitate an effective financial or programmatic
audit.
