AND OTTINGER ROAD, INTO THE TOWN LIMITS OF THE TOWN OF
WESTLAKE, TEXAS, PURSUANT !;i OF
LOCAL i i1CONFIRMING AND RATIFYING THE PRIOR
ANNEXATIONS OF THE AREA UNDER ORDINANCES 237, 253, AND 289;
PROVIDING FOR A SEVERABILITY CLAUSE; AND PROVIDING FOR AN
EFFECTIVE DATE
WHEREAS, the majority of the qualified voters of the area more specifically defined as
approximately 56.8647 acres of the Jesse Gibson Survey, Abstract No. 592, Tarrant County,
Texas, have voted to request the Town of Westlake to annex the property as shown on attached
Exhibit "A", (hereinafter the "Area"); and
WHEREAS, three (3) qualified voters of the Area have prepared and executed an
affidavit to the fact of the vote and filed it with the Mayor of the Town of Westlake; and
WHEREAS, the Area was previously annexed into the Town under Ordinance Nos. 237,
253, and 289; and the property owners nor any of their predecessors have ever petitioned for
disannexation; and
WHEREAS, the majority of the qualified voters of the Area wish to confirm and ratify
the annexation of the Area under those ordinances, and, in the alternative, have their Area
annexed by this ordinance; and
WHEREAS, the Area is one-half mile or less in width; and
WHEREAS, the Town of Westlake is a Type -A gen=eral law municipality; and
WHEREAS, the Area is contiguous to the current Town Limits of the Town of
Westlake, Texas; and
WHEREAS, the Mayor has certified to the Board of Aldermen of the Town of Westlake
the filed Affidavit submitted to the Mayor, the Affidavit being attached hereto and incorporated
herein as Exhibit "B"; and
WHEREAS, all of the provisions of Section 43.024 of the Texas Local Government
Code have hereby been met.

NOW, THEREFORE, BE IT ORDAINED BY THE 130ARD OF ALDERMEN OF THE
TOWN OF WESTLAKE, TEXAS:
SECTION 1. That all of the above findings and exhibits are true and correct and are
incorporated into the body of this Ordinance in their entirety.
SECTION 2. That the Area shown on attached Exhibit "A" is hereby annexed into the
Town Limits of the Town of Westlake, Texas, for full municipal purposes; and the annexation of
the Area under Ordinances Nos. 237, 253, and 289 is hereby confirmed and ratified.
SECTION 3. That the terms and provisions of this Ordinance shall be deemed to be
severable and -that if the validity of any section, subsection, sentence, clause or phrase of this
Ordinance should be declared invalid or unconstitutional by the valid judgment or decree of any
court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity
of any other section, subsection, sentence, clause or phrase of this Ordinance.
SECTION 4. This Ordinance shall become effective from and after its date of passage.

been duly sworn depose as follows:
1. "Our names are Scott Bradley, Kelly Pace Bradley, and Joe Allen Bradley. Each of us is
over the age of eighteen, has never been convicted of a felony, and is of sound mind, fully
capable of making this affidavit and personally acquainted with the facts herein stated:
2. We are qualified voters of an area contiguous to the Town Limits of the Town of
Westlake, and as shown and described in the attached Exhibit A (hereinafter the "Property"). The
Property is located within the extraterritorial jurisdiction of the Town of Westlake, is contiguous
to the Town Limits of the Town of Westlake, and is one-half mile or less in width.
3. We hereby certify that on this the 13th day of June 2005, an election was held among the
voters who reside on the Property, and that in such election a majority of voters voted in favor of
the Property becoming a part of the Town of Westlake. By filing this Affidavit with the Mayor of
the Town of Westlake, care of the Town of Westlake, we certify that a majority of the voters in
the area of the Property desire that the Property be annexed by the Town of Westlake in
accordance with Section 43.024 of the Texas Local Government Code."

in Westlake, and partially in Keller, Tarrant County, Texas, and being part of
the W.T. Sharpless called 40 acre tract described in Volume 1324, Wage 254,
Deed Records, Tarrant County, 'texas, and all of tract 3, as recorded in
Partition Deed recorded in Volume 2839, rage 41, Heed Records, Tarrant County,

to a 1/2 inch iron rod found at a fence corner running North --South and West,
and being the Southeast corner of the tract described herein, and the Northeast
