HomeMy WebLinkAboutRes 89-04 Boundary Adjustment Agreement with Trophy Club TOWN OF WESTLAKE, TEXAS RESOLUTION NO. --T A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF !WESTLAKE, TEXAS APPROVING AND ADOPTING A BOUNDARY ADJUSTMENT AGREEMENT BY AND BETWEEN THE TOWN AND THE TOWN OF TROPHY CLUB, TEXAS; AUTHORIZING THE TOWN MAYOR TO EXECUTE THE AGREEMENT; PROVIDING AN EFFECTIVE DATE. BE I'.T RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF WESTLAKE, TEXAS: Section 1. That the Town Council of the Town of Westlake, Texas (the "Town") does hereby accept, adopt and approve the' Boundary Adjustment Agreement (the "Agreement" ) by and between ' the Town and the Town of Trophy Club, Texas, a true and correct; copy of which Agreement is attached hereto and incorporated herein for all purposes . i Section 2 . That the Mayor of the Town is hereby authorized and empowered to execute the Agreement on behalf of the Town. Section 3 . That this resolution shall take effect from and after its date of passage. Mayor, Town of Westlake, Texas ATTEST: T n Se,6ret6ry Town of Westlake, Texas [SEAL] APPROVED ASTO FORM: Town Attorney Town of Westlake, Texas 0222] STATE OF TEXAS § § BOUNDARY ADJUSTMENT AGREEMENT COUNTY OF DENTON § WHEREAS, the Town of Trophy Club, Texas ("Trophy Club") and the Town of Westlake, %Texas ("Westlake") (together, the "Towns") are duly incorporated municipalities under the laws of the State of Texas and are located in Denton County, Texas; and WHEREAS, pursuant to Ordinance No. 1 5_(9 _ of the Town of Westlake, e� Texas, Westlake relinquished and discontinurom its extraterritorial juris- diction all of that territory which comprises the corporate boundaries of Trophy Club, less a ten (10) foot strip (the "ten (10) foot strip") of land which generally surrounds all; of the territory lying within Trophy Club north of State Highway 114, which ton (10) foot strip is more accurately described by metes and bounds in Exhibit "A" attached hereto and incorporated herein for all purposes; and t WHEREAS, the ten (10) foot strip is contiguous and adjacent to the corporate limits of Trophy Club; and WHEREAS, the Towns are authorized and empowered pursuant to article 970x, §7.B4.(a), Vernon's Texas Revised Civil Statutes, as amended, to accomplish mutually agreeable adjustments in their boundaries of areas that are less than five hundred (500) feet in width; and WHEREAS, the Towns mutually agree that because of the proximity of the ten (10) foot strip to Trophy Club, said strip of land would be more adequately served by Trophy Club with municipal services; and WHEREAS, the respective Town Councils of the Towns have heretofore determined that this Boundary Adjustment Agreement is in the best interest of the health, safety, morals and welfare of the citizens of the respective Towns and have authorized the Mayor of each of the Towns to execute this Agreement. NOW, THEREFORE, for and in consideration of the mutual promises and benefits flowing to both parties to this Agreement, the receipt and sufficiency of which is 'hereby acknowledged, the Town of Trophy Club and the Town of Westlake do hereby CONTRACT, COVENANT, WARRANT and AGREE as follows: Section 1. That all of the above premises are found to be true and correct and are incorporated into the body of this Boundary Adjustment Agreement as if copied herein in their entirety. Section 2. Westlake hereby disannexes, discontinues and relinquishes from its corporate jurisdiction all that certain ten (10) foot strip of land, together with all extraterritorial jurisdiction attached thereto, as described in Exhibit "A," attached hereto and incorporated herein for all purposes, and grants Trophy Club all of its rights, powers and privleges in and to such strip of land. Section 3.
