HomeMy WebLinkAboutOrd 792 Amending Chapter 50 Manufactured Home Section 50-3 Trailers ORDINANCE NO. 792 AN ORDINANCE OF THE TOWN OF WESTLAKE, TEXAS, AMENDING CHAPTER 50, SECTION 50-3, SUBSECTIONS (e) and (d) BY DELETING SUBSECTION (c) ALLOWING FOR A TEMPORARY TRAILER; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL OF CONFLICTING PROVISIONS; PROVIDING A CUMULATIVE CLAUSE; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the Town of Westlake, Texas, (the "Town") is a General Law Municipality located in Tarrant and Denton Counties, Texas, created in accordance with the provisions of the Texas Local Government Code and operating pursuant to the enabling legislation of the State of Texas; and WHEREAS, the Town Council of Westlake, Texas, deems it necessary to amend this Ordinance by deleting provisions allowing for temporary trailer occupancy in residential areas within the corporate limits of the Town. WHEREAS,the Town Council of the Town of Westlake, Texas, is of the opinion that it is in the best interests of the town and its citizens that the amendments should be approved and adopted. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF WESTLAKE, TEXAS: SECTION 1: That the above findings are hereby found to be true and correct and are incorporated herein in their entirety. SECTION 2: That, the Town hereby repeals subsections(c) and(d) of Section 50-3 and amends section 50-3 to read as follows: Sec. 50-3. - Exemptions. (a) Any mobile home existing and occupied on August 21, 1974, is exempt from the terms of this chapter, but if a mobile home is moved it cannot be replaced by another mobile home, and if a mobile home is unoccupied on that date, it shall be removed within 30 days. If the mobile home is not removed within 30 days then the town manager or designee will notify the owner by written notice sent by certified mail that the mobile home must be removed and the owner and/or occupant will have five days from receipt of the notice to remove the mobile home. If it still remains, the town will make arrangements for the mobile home to be removed and the costs involved will be charged against the owner and/or occupant. (b) The provisions of section 50-2 shall have no application to those trailers which are placed on a lot or lots temporarily for construction purposes to be used as a construction site office, but such office may not be maintained as a residence and shall be in compliance with section 102-65. Ordinance 792 Page 1 of 2 SECTION 3: All rights and remedies of the Town of Westlake, Texas, are expressly saved as to any and all violations of the provisions of the prior ordinance sections which existed at the time of the effective date of this Ordinance; and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such ordinances, the same shall not be affected by this Ordinance but may be prosecuted until final disposition by the courts. SECTION 4: It is hereby declared to be the intention of the Town Council of the Town of Westlake, Texas, that sections,paragraphs, clauses and phrases of this Ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this Ordinance shall be declared legally invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such legal invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs or sections of this Ordinance since the same would have been enacted by the Town Council of the Town of Westlake without the incorporation in this Ordinance of any such legally invalid or unconstitutional,phrase, sentence, paragraph or section. SECTION 5: That any person, firm or corporation violating any of the provisions or terms of this ordinance shall be subject to the same penalty as provided for in the Code of Ordinances of the Town of Westlake, and upon conviction shall be punishable by a fine not to exceed the sum of Five Hundred ($500.00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. SECTION 6: This Ordinance shall be cumulative of all provisions of ordinances of the Town except where the provisions of this Ordinance are in direct conflict with the provisions of such ordinances, in which event the conflicting provisions of such ordinances are hereby repealed. SECTION 7: This ordinance shall take effect immediately from and after its passage as the law in such case provides. PASSED AND APPROVED ON THIS 19th DAY OF SEPTEMBER 2016.
