RECOMMENDATION The Owner's Certificate on the Final Plat for the Circle T Ranch Office Campus, Lot 1, Block 1 does not provide the Town protection from easements being granted by the applicant that could adversely affect the Town of Westlake. Hillwood has been asked to provide the required language in the plat that allows for the additional uses of the easement by Hillwood, subject to Town approval. If the language is forwarded before the P&Z meeting to staff's satisfaction then the plat is recommended for approval. If it is not, then P&Z should deny the plat. BACKGROUND The applicant has submitted a final plat for the Daimler Chrysler Development. The applicant has previously received approval of the preliminary plat and site plan from the Town. The construction has been completed. The Circle T Ranch Office Campus, Lot 1, Block 1 consists of the 13.175 acres that comprises the Daimler Chrysler office campus. The open space and the roadway dedication instruments meet all Town standards and do not require P&Z or Board approval. H I LLWOOD Memo To: Trent Petty From: Joseph C. These were updated per the comments we had received from Stan on Friday Morlung(August 2,2002). We understand that there is still concern on the Town's part regarding the wording in our easement dedication language stipulating our reservation of the right to grant other easements across, over and under the easements depicted on the plats. We will work with the town to come up with mutually acceptable language to address the Town's concerns regarding our reservation in the easement documents prior to the upcoming Planning and Zoning Commission and Board of Alderman's meetings. Russell Laughlin Senior mice President HILLWOOD PROPERTIES 817 224 6017 July 25, 2002 Mr:Trent Petty, Town Manager Town of Westlake 3 Village Circle, Suite 207 Westlake, TX 76262 Re: Future Right-of-Way Requirements for Underground Electric Service Roanoke Road, CT Corporate Center No. 1 Dear Trent: As we have discussed, the public road improvements for Roanoke Road along and adjacent to the CT Corporate Center No. I site (the Daimler Chrysler facility) have been completed. As future development of the office campus tracts adjacent to the CT Corporate Center No. 1 site occurs, additional right-of-way for Roanoke Road may be required for placing the existing overhead Tri-County service lines underground. The size and configuration of the future platted lots adjacent to the CT Corporate Center site will dictate whether or not a permanent electric service route for Tri-County is required along the completed section of improved Roanoke Road. It is anticipated that this development issue will be addressed as part of the Town of Westlake's preliminary and final plat process and site plan approval for the future developments. If it is determined at that time that a permanent electric service route is required, then AIL Investment, L.P. will dedicate up to an additional 20' of right-of- way along the eastern right-of-way boundary of Roanoke Road adjacent to the CT Corporate Center No. I site, for up to a total right-of-way width of 90', to accommodate the electric service route within the Roanoke Road right-of-way; and Hillwood will cause the existing Tri-County overhead lines to be buried underground within the right-of-way of Roanoke Road. Alternatively, if it is determined that a permanent electric service route is not needed for the future adjacent developments, then the existing overhead service will be abandoned and removed by Tri-County as alternative permanent services routes are provided. Trent, I trust this letter fully addresses Hillwood's commitment to provide for and complete the burial of permanent electric service along Roanoke Road if required in the future.
