2. CITIZENS' PRESENTATIONS: This is an opportunity for citizens to address the Board on any
matter whether or not it is posted on the agenda. The Board cannot by law take action nor have

item not listed on the agenda. Any item presented may be noticed on a future agenda for
deliberation or action.
3. CONSIDER A RESOLUTION AUTHORIZING THE RETENTION OF CURRENT
STUDENTS WHO WERE ACCEPTED IN THE PAST BUT WHO RESIDE OUTSIDE
THE CURRENT SECONDARY GEOGRAPHIC BOUNDARY ESTABLISHED BY THE
ORIGINAL CHARTER; AND THE RETENTION OF ROBERT A. SCHULMAN OF THE
LAW FIRM OF FELDMAN AND ROGERS TO REPRESENT THE ACADEMY IN
MATTERS RELATING TO THE EDUCATION CODE.

Consider a resolution authorizing the retention of current students who were accepted in the past
but who reside outside the current secondary geographic boundary established by the original
charter; and the retention of Robert A. Schulman of the law firm of Feldman and Rogers to
represent the Academy in matters relating to the Education Code.
RECOMMENDATIONS:
Staff recommends approval.
BACKGROUND:
In April of 2007, the Board of Trustees of Westlake Academy approved a resolution expanding
the Geographic Boundaries for Transfer Students. This resolution was used to accompany a
request for a waiver for submitting a late amendment to our Charter. During the Charter renewal
process, in February of 2007, it was discovered that ten Westlake Academy students who
currently reside outside the secondary boundary of the school were inadvertently allowed to
enroll in the school during the past four years. All of the students admitted were in towns or
cities that are served by more than one ISD and the mistake could have been easily made. Once
we had that information, the Academy self-reported it to the TEA Charter School Division.
At first we were told that the students in question would have to leave the Academy
immediately. When we said that that was not an option if we were to have the children's well-
being and education as the focus, we were told that we could allow those students to finish the
year but would not receive funding for them. We were also told that the only way to keep the
students would be to make an expansion amendment to our Charter. But the February 1 deadline
had been February l St already passed.
We consulted with the Commissioner of Education, who suggested that we ask for a waiver; the
waiver had to include the Board Resolution to include the expansion. This was forwarded to the
Commissioner's office and some time later we were sent the official waiver forms, which was
executed and returned. Unfortunately, the waiver ivas denied by a letter dated May 18tH
The Head of School and the President of the Board of Trustees have consulted with Mr. Robert
A. Schulman, Esq., of the firm of Feldman and Rogers, who .are education law specialists. Mr.

Feldman is helping us to devise a way of letting these students remain at the school although
they would not be eligible for state funding.

RESOLUTION NO. 07-08
A RESOLUTION OF THE BOARD OF TRUSTEES OF WESTLAKE ACADEMY,
AUTHORIZING THE RETENTION OF CURRENT STUDENTS WHO WERE
ACCEPTED IN THE PAST BUT WHO RESIDE OUTSIDE THE CURRENT
SECONDARY GEOGRAPHIC BOUNDARY ESTABLISHED BY THE
ORIGINAL CHARTER; AND THE RETENTION OF ROBERT A. SCHULMAN
OF THE LAW FIRM OF FELDMAN AND ROGERS TO REPRESENT THE
ACADEMY IN MATTERS RELATING TO THE EDUCATION CODE.
BE IT RESOLVED BY THE BOARD OF TRUSTEES OF WESTLAKE
ACADEMY:
WHEREAS, five current students of Westlake Academy currently reside outside
the secondary geographic boundary established by the Academy's original charter;
WHEREAS, the Academy has applied to the Texas Education Agency for a
waiver of the February 1 deadline for amending the Charter to include in the secondary
geographic boundary the area in which these students reside, which waiver has been
denied;
WHEREAS, the Academy continues to seek the waiver;
WHERAS, the Board determines that it is in the best interest of the children and
the community that these children be allowed to remain at the Academy even if the Texas
Education Agency does not reimburse the per diem amount associated with the
attendance of these students for the 2007-2008 school year.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF
THE WESTLAKE ACADEMY:
SECTION 1: That this Resolution shall become effective upon the date of its
passage.
PASSED AND APPROVED ON THIS 25th DAY OF JUNE, 2007.
